Um 00:08:46.440 --> 00:08:49.509 I wanted to bring the CP CS attention to the fact that 00:08:49.519 --> 00:08:52.989 there's been a long history of embrittlement of uh 00:08:53.000 --> 00:08:57.849 reactor vessel on unit one at Diablo Canyon that was 00:08:57.859 --> 00:09:02.269 first documented as early as 1987. It's been recognized 00:09:02.279 --> 00:09:07.009 by the NRC as being among the top four most emb brittle 00:09:07.029 --> 00:09:10.129 reactors in the United States and continues to have 00:09:10.139 --> 00:09:17.750 that status today. Um The um means by which um PG and 00:09:17.759 --> 00:09:23.080 E is claiming compliance with very specific mathematical 00:09:23.090 --> 00:09:27.469 equations and procedures that the NRC requires for 00:09:27.479 --> 00:09:32.149 screening embrittlement of limiting uh materials is 00:09:32.158 --> 00:09:35.109 highly questionable. They're currently doing this under 00:09:35.119 --> 00:09:38.779 their current license application. Um I believe in 00:09:38.788 --> 00:09:41.808 a manner that's inconsistent with NRC regulations and 00:09:41.820 --> 00:09:45.139 I'm going to be sending you a 10 page white paper on 00:09:45.149 --> 00:09:49.440 this topic. Uh I've done over 5000 pages of research 00:09:49.450 --> 00:09:53.139 on NRC documents have worked directly with physicists 00:09:53.149 --> 00:09:56.840 who are well known in this field and I, I don't believe 00:09:56.849 --> 00:10:00.840 this is imaginary. Um And I, I'm very concerned that 00:10:00.849 --> 00:10:03.879 we need to do additional embrittlement testing. It 00:10:03.889 --> 00:10:05.969 would cost about a million dollars to do that. We're 00:10:05.979 --> 00:10:09.750 considering a $1.4 billion investment in the reactor 00:10:10.168 --> 00:10:14.950 It seems to me a very clear cost benefit to consider 00:10:14.960 --> 00:10:18.168 the additional safety testing. PG and E claims that 00:10:18.178 --> 00:10:21.989 they are exempt from requiring. Um I'll be sending 00:10:22.000 --> 00:10:24.190 you a white paper on this topic. There 00:14:14.879 --> 00:14:18.739 is local opposition producing some misinformation about 00:14:18.750 --> 00:14:23.418 wildlife safety. But if we look to re verifiable research 00:14:23.428 --> 00:14:27.158 that's being done by the Board of um Offshore Energy 00:14:27.168 --> 00:14:31.359 Management and two successes at the South Fork Wind 00:14:31.369 --> 00:14:35.379 Farm off um Long Island and to acoustic studies being 00:14:35.389 --> 00:14:39.658 done at Duke University and to um studies demonstrating 00:14:39.668 --> 00:14:44.229 the safety to seabirds at the um extensive um offshore 00:14:44.239 --> 00:14:49.690 wind farms um off the coast of England. Um These projects 00:14:49.700 --> 00:14:54.580 should be done with um consideration for wildlife safety 00:14:54.590 --> 00:14:57.619 and they can be done with consideration for wildlife 00:14:57.629 --> 00:15:03.109 safety. I think it's 00:15:36.029 --> 00:15:40.099 a big mistake. I think that money is not well spent 00:15:40.109 --> 00:15:45.048 because we have enough. We will have enough uh good 00:15:45.058 --> 00:15:51.210 old uh green energy to keep the lights on in California 00:15:51.219 --> 00:15:56.009 And we don't need uh the nuclear power plant. Uh Wind power does not 00:17:08.078 --> 00:17:10.920 require mining or drilling for fuel. Its costs are 00:17:10.930 --> 00:17:14.039 therefore not susceptible to fluctuations in fossil 00:17:14.049 --> 00:17:17.789 fuel prices. Furthermore, offshore wind is more consistent 00:17:17.799 --> 00:17:21.680 than onshore wind or solar power. Therefore, it helps 00:17:21.689 --> 00:17:24.650 compensate for the intermittent nature of these power 00:17:24.660 --> 00:17:28.630 sources. The project will 01:26:41.008 --> 01:26:44.788 serve mountainous and rural communities that are unserved 01:26:44.798 --> 01:26:48.008 right now because of the high cost of deployment. Cal Neva is proposing to serve up 01:29:01.597 --> 01:29:07.057 to 600,000 excuse me, 600 households in Fresno County 01:29:07.228 --> 01:29:12.129 The project cost is 519,000. Cal Neva operates in the 01:29:12.139 --> 01:29:16.428 cities of Huron and Coalinga which include remote farming 01:29:16.438 --> 01:29:20.028 communities that are unserved and underserved. I am very pleased that the affordable housing 01:30:26.998 --> 01:30:30.077 community is taking advantage of our grant program 01:30:30.248 --> 01:30:34.087 to support internet access for their residents. Las Palmas housing and development corporation 01:30:41.018 --> 01:30:45.548 RC D Housing and self help enterprises. They'll deploy 01:30:45.557 --> 01:30:50.119 wireless and wired broadband infrastructure for 346 01:30:50.129 --> 01:30:53.768 affordable housing units and thus the residents will 01:30:53.778 --> 01:30:56.688 have better access to everything that's made possible 01:30:56.698 --> 01:31:01.698 by high quality internet. Rounding out the base item 01:31:01.708 --> 01:31:06.659 12 is an infrastructure award to LCB Communications 01:31:07.458 --> 01:31:11.557 LCB. Communications will provide fixed wireless technology 01:31:11.577 --> 01:31:16.718 to bring internet to 1101 eligible households in low 01:31:16.728 --> 01:31:20.248 income communities of San Benito, Santa Cruz and Monterey 01:31:20.258 --> 01:31:26.629 counties. The project cost is about 29.5 million. Speaker 01:32:01.218 --> 01:32:05.258 Rivas wrote to us saying the district covers over 140 01:32:05.268 --> 01:32:09.698 miles of challenging terrain with steep narrow canyons 01:32:09.708 --> 01:32:13.823 heavily wooded and high fire threat zones. Families 01:32:13.833 --> 01:32:17.514 in our region continue to suffer from inadequate broadband 01:32:17.524 --> 01:32:21.364 access. They're unable to fully participate in public 01:32:21.373 --> 01:32:24.913 economic or academic life. These are the gaps that 01:32:24.923 --> 01:32:29.899 this project will address. LCB is also a successful 01:32:29.909 --> 01:32:35.337 repeat grantee in 2021. They completed another infrastructure 01:32:35.347 --> 01:32:39.619 project with CASF funds and provided broadband access 01:32:39.629 --> 01:32:44.298 to 150 households in a portion of rural unincorporated 01:32:44.639 --> 01:32:49.288 Santa Clara County. The projects were submitted by regional 01:40:43.508 --> 01:40:46.358 internet service providers, nonprofits and housing 01:40:46.367 --> 01:40:50.978 authorities and they'll provide free or low cost options 01:40:50.989 --> 01:40:55.128 for low income households. The infrastructure projects 01:40:55.137 --> 01:40:58.489 in particular are notable for the variety of solutions 01:40:58.499 --> 01:41:02.617 that they provide including fiber, coaxial cable, cable 01:41:02.628 --> 01:41:06.508 and fixed wireless technologies. In 1994 01:45:43.068 --> 01:45:45.599 the legislature tasked the commission with initiating 01:45:45.608 --> 01:45:48.208 a proceeding to ensure universal telecommunication 01:45:48.217 --> 01:45:51.467 services include essential telecommunication services 01:45:51.478 --> 01:45:54.289 provided at affordable prices to all Californians. 01:45:55.318 --> 01:45:58.117 In response to this, the commission decided to designate 01:45:58.128 --> 01:46:01.157 existing incumbent telephone providers in each service 01:46:01.168 --> 01:46:04.398 territory to be carriers of last resort, also known 01:46:04.407 --> 01:46:07.999 as callers in their service territories to ensure that 01:46:08.008 --> 01:46:10.978 all customers receive service. Consistent with universal 01:46:10.989 --> 01:46:15.269 service policy. Back in the nineties, there were major 01:46:15.278 --> 01:46:18.019 changes to the telecommunications regulatory structure 01:46:18.028 --> 01:46:21.749 at the state and federal levels. A regulatory regime 01:46:21.758 --> 01:46:24.548 founded on the rate regulation of universal service 01:46:24.559 --> 01:46:28.367 monopoly utility transitioned to a market based regulatory 01:46:28.378 --> 01:46:31.739 structure. But with a continued commitment to universal 01:46:31.749 --> 01:46:36.849 service to essential communi telecommunications support 01:46:36.858 --> 01:46:39.588 for universal service came in many forms including 01:46:39.599 --> 01:46:43.628 means tested subsidized service for Californians continuing 01:46:43.637 --> 01:46:46.769 financial support for the service of Californians in 01:46:46.778 --> 01:46:50.099 some high cost areas. And our continued expectation 01:46:50.108 --> 01:46:52.829 that there will be a carrier responsible for providing 01:46:52.838 --> 01:46:57.249 basic service everywhere in the state. With some adjustments 01:46:57.258 --> 01:47:00.008 our carry of last resort rules have been in place since 01:47:00.019 --> 01:47:04.079 1996. At time that we were firmly in the midst of the.com 01:47:04.088 --> 01:47:08.008 boom. A lot has changed in the telecom industry since 01:47:08.019 --> 01:47:11.758 those rules were created including dramatic transitions 01:47:11.769 --> 01:47:16.088 to mobile connectivity and higher speed broadband services 01:47:16.338 --> 01:47:19.157 Not to mention billions of dollars of state and federal 01:47:19.168 --> 01:47:22.099 investment in the deployment of more advanced networks 01:47:22.108 --> 01:47:27.028 to unserved and underserved parts of the state. 01:47:27.028 --> 01:47:29.407 Given changes in the telecommunications landscape. 01:47:29.418 --> 01:47:33.867 Since the Ker rules were adopted in 1996 the time is 01:47:33.878 --> 01:47:36.697 ripe for the commission to examine the Ker rules and 01:47:36.708 --> 01:47:41.657 consider changes and updates. Many changes in the telecommunications 01:47:41.668 --> 01:47:45.539 sphere have arisen since the color rules were adopted 01:47:45.548 --> 01:47:48.188 when the majority of phone users were using plain old 01:47:48.197 --> 01:47:51.489 telephone service or landline service on the traditional 01:47:51.499 --> 01:47:55.927 uh copper network. Whereas now many users also use 01:47:55.938 --> 01:47:59.168 other forms of voice service including cellular service 01:47:59.177 --> 01:48:02.989 over uh over wireless voice over internet protocol 01:48:03.559 --> 01:48:07.407 and broadband or advanced networks for data access 01:48:09.378 --> 01:48:12.648 When the color rules were adopted, carriers met their 01:48:12.657 --> 01:48:15.688 cooler obligation through landline telephone service 01:48:15.697 --> 01:48:19.088 on a legacy telephone network and typically still meet 01:48:19.099 --> 01:48:21.427 their obligation through service on that network. Today 01:48:22.228 --> 01:48:25.309 It's important to note however, that colors can meet 01:48:25.318 --> 01:48:28.798 their color obligations using any technology and are 01:48:28.809 --> 01:48:31.588 not limited to plain old telephone service, copper 01:48:31.599 --> 01:48:36.367 lines technology. While current callers are still performing 01:48:36.378 --> 01:48:39.387 their obligations through landline service over copper 01:48:39.398 --> 01:48:42.617 networks, the rules themselves are technology neutral 01:48:44.378 --> 01:48:47.438 We also recognize that the telecommunication landscape 01:48:47.447 --> 01:48:50.079 is increasingly shifting away from plain old telephone 01:48:50.088 --> 01:48:53.318 service or landline service to other forms of communication 01:48:53.728 --> 01:48:55.769 and that there's an increase in the number of alternative 01:48:55.778 --> 01:48:59.088 voice service providers. However, these alternative 01:48:59.099 --> 01:49:02.637 voice service providers are not designated followers 01:49:02.648 --> 01:49:05.809 may not necessarily provide universal service and are 01:49:05.818 --> 01:49:10.809 not obligated to provide universal service. This proposed 01:49:10.818 --> 01:49:13.499 rule making will consider changes and updates to the 01:49:13.508 --> 01:49:17.539 commission's rules for carriers of last resort, a carrier 01:49:17.548 --> 01:49:20.739 last resort or Ker again is a telecommunication service 01:49:20.749 --> 01:49:23.197 provider that receives a subsidy from the state and 01:49:23.208 --> 01:49:25.818 stands ready to provide basic telephone service which 01:49:25.829 --> 01:49:29.519 includes 911 access and other public service access 01:49:29.769 --> 01:49:33.117 to any customer requesting such service within a specified 01:49:33.128 --> 01:49:37.188 area. At least one telephone company in a specified 01:49:37.197 --> 01:49:40.617 area is legally required to provide access to basic 01:49:40.628 --> 01:49:43.769 service to anyone in its service territory who requests 01:49:43.778 --> 01:49:47.918 it. That's the coal obligation. It ensures that everyone 01:49:47.927 --> 01:49:51.249 in California has access to safe, reliable and affordable 01:49:51.258 --> 01:49:55.278 basic telephone service. The commission's rules regarding 01:49:55.289 --> 01:50:00.228 Fuller, which we'll also call color rules require a 01:50:00.239 --> 01:50:04.478 color in all service areas in the state accordingly 01:50:04.489 --> 01:50:08.039 Our rules establish that a provider that is a Ker can't 01:50:08.048 --> 01:50:11.508 be relieved of its co obligations in a particular area 01:50:11.978 --> 01:50:15.677 unless another carrier can serve as CO R in that same 01:50:15.688 --> 01:50:19.407 area. There are also requirements that the carrier 01:50:19.418 --> 01:50:22.387 must meet in order to be designated as and approved 01:50:22.398 --> 01:50:26.568 by the commission to be a killer. 01:50:26.568 --> 01:50:28.608 Some of the questions that will be covered in the rule 01:50:28.617 --> 01:50:32.117 making are if and how the commission should revise 01:50:32.128 --> 01:50:34.967 the color rules given these tensions and realities 01:50:34.978 --> 01:50:37.789 and changes in the landscape of the telecommunications 01:50:37.798 --> 01:50:42.208 industry. For example, one consideration is how to 01:50:42.217 --> 01:50:44.478 evaluate the color rules given the evolution of our 01:50:44.489 --> 01:50:46.947 networks and our state's commitment to investing in 01:50:46.958 --> 01:50:51.539 newer and advanced networks. We currently have a 100 01:50:51.548 --> 01:50:55.298 plus year old legacy telephone network infrastructure 01:50:55.309 --> 01:50:58.648 that is already uh present throughout the state and 01:50:58.657 --> 01:51:01.568 that has been used and continues to be used to provide 01:51:01.849 --> 01:51:06.269 universal service. Alongside that California along 01:51:06.278 --> 01:51:09.467 with the federal government have made clear our commitments 01:51:09.478 --> 01:51:12.338 and goals to bridge the digital divide and have poured 01:51:12.349 --> 01:51:15.088 grant funding to support investment in new advanced 01:51:15.099 --> 01:51:17.447 networks like broadband networks as we've been doing 01:51:17.458 --> 01:51:20.019 today. 01:51:20.019 --> 01:51:22.688 Some questions that arise from this to address in the 01:51:22.697 --> 01:51:25.188 rule making are generally how we should revise color 01:51:25.197 --> 01:51:28.148 rules in light of this network evolution. For example 01:51:28.157 --> 01:51:30.499 should we be putting in similar levels of investment 01:51:30.508 --> 01:51:33.398 in the legacy network as we are in advanced networks 01:51:33.407 --> 01:51:36.197 Given that the legacy network continues to provide 01:51:36.208 --> 01:51:41.958 universal service to parts of California 01:51:41.958 --> 01:51:45.258 for some Californians and emergency first responders 01:51:45.289 --> 01:51:48.427 Landline service has been the most reliable form of 01:51:48.438 --> 01:51:52.318 telephone service, especially during power outages 01:51:52.329 --> 01:51:56.269 and emergencies. This tension must also be considered 01:51:56.278 --> 01:51:58.838 in the examination of the Cola rules and the revisions 01:51:59.228 --> 01:52:01.708 The other question is how we should be adjusting our 01:52:01.717 --> 01:52:04.878 co expectations in light of the level of investment 01:52:04.887 --> 01:52:09.559 both state and private in new networks. I will also 01:52:09.568 --> 01:52:11.887 note that there's a physical infrastructure problem 01:52:11.898 --> 01:52:14.228 that should be addressed in consideration of our color 01:52:14.239 --> 01:52:17.407 rules. While there has been successful deployment of 01:52:17.418 --> 01:52:20.697 multiple services by multiple voice service providers 01:52:20.708 --> 01:52:24.088 in various parts of the state, there are still physical 01:52:24.099 --> 01:52:26.728 infrastructure challenges that impact service availability 01:52:27.818 --> 01:52:31.019 areas with higher population density have tended to 01:52:31.028 --> 01:52:34.048 see more providers offering service with higher levels 01:52:34.059 --> 01:52:36.289 of investment in infrastructure in these areas, with 01:52:36.298 --> 01:52:39.978 a denser customer base over a small footprint in a 01:52:39.989 --> 01:52:43.298 city like San Francisco. 1 may see a panoply of companies 01:52:43.309 --> 01:52:46.258 offering different services like end to end cellular 01:52:46.269 --> 01:52:49.958 network services, wired networks that offer DS L and 01:52:49.967 --> 01:52:52.867 fiber service and cable networks offering phone service 01:52:52.878 --> 01:52:55.717 and broadband service along with other solutions like 01:52:55.728 --> 01:53:00.398 hybrid fiber optic cabling with wireless links. 01:53:00.398 --> 01:53:03.418 However, there may still be physical issues that impact 01:53:03.427 --> 01:53:07.137 service availability and may provide barriers to the 01:53:07.148 --> 01:53:11.898 entry of new competitive uh offerings such as physical 01:53:11.907 --> 01:53:15.197 weight constraints on utility poles, access to rights 01:53:15.208 --> 01:53:17.778 of way and limited physical infrastructure that can 01:53:17.789 --> 01:53:21.398 prevent present these kinds of barriers. 01:53:21.398 --> 01:53:23.697 On the other hand, remote and less dense parts of the 01:53:23.708 --> 01:53:27.608 state may not see the same number of companies investing 01:53:27.617 --> 01:53:30.217 in and building out the network given the lower density 01:53:30.228 --> 01:53:32.838 of customers to serve. But the still high physical 01:53:32.849 --> 01:53:35.967 infrastructure costs to deliver a performing network 01:53:35.978 --> 01:53:40.999 for customers. Thus, we often see less investment in 01:53:41.008 --> 01:53:44.628 physical infrastructure in these remote areas. So I 01:53:44.637 --> 01:53:47.637 see this proposed rule making as a timely opportunity 01:53:47.648 --> 01:53:51.697 to address these important questions and others. 01:53:51.697 --> 01:53:54.858 While the rule making may result in a change to color 01:53:54.867 --> 01:53:57.798 rules. What will not change is the commission's commitment 01:53:57.809 --> 01:54:00.978 to universal service that provides safe, reliable and 01:54:00.989 --> 01:54:03.677 affordable communications for all Californians, regardless 01:54:03.688 --> 01:54:07.028 of a customer's location, financial circumstances or 01:54:07.039 --> 01:54:10.798 the remoteness and difficulty of the terrain. These 01:54:10.809 --> 01:54:12.708 are the very customers, the legislature and the commission 01:54:12.717 --> 01:54:16.108 designed the color rules to serve and protect and that 01:54:16.117 --> 01:54:19.269 commitment will not change. 01:54:19.269 --> 01:54:22.617 I'd like to take a moment to also discuss an item on 01:54:22.628 --> 01:54:26.137 the consent agenda item 50 on the dismissal of AT&T 01:54:26.148 --> 01:54:28.508 s application to be relieved of its core obligation 01:54:28.519 --> 01:54:30.887 which I think is a helpful frame for this rule making 01:54:32.079 --> 01:54:35.298 AT&T is the carrier of last resort in much of California 01:54:35.447 --> 01:54:38.099 Given that it holds the legacy telephone network in 01:54:38.108 --> 01:54:42.309 much of the state. On today's consent agenda, we voted 01:54:42.318 --> 01:54:45.309 to approve the decision, dismissing AT&T S application 01:54:45.407 --> 01:54:48.438 I'd like to take a moment to address AT&T S request 01:54:48.447 --> 01:54:52.108 to withdraw from its color obligations based on its 01:54:52.117 --> 01:54:54.728 interpretation of statute and commission rules that 01:54:54.739 --> 01:54:58.157 the commission may grant AT&T S request without an 01:54:58.168 --> 01:55:01.269 approved color replacement, obligated to provide basic 01:55:01.278 --> 01:55:04.559 service to anyone who asks for it. 01:55:04.559 --> 01:55:08.289 AT&T S interpretation is incorrect. And if the commission 01:55:08.298 --> 01:55:11.637 allowed AT&T to withdraw as a color without a replacement 01:55:11.648 --> 01:55:14.849 in place, this would defeat, defeat the purpose of 01:55:14.858 --> 01:55:17.499 the existing color rules that were designed to ensure 01:55:17.508 --> 01:55:20.588 universal service to all Californians in every territory 01:55:21.478 --> 01:55:24.867 Our vote to dismiss AT&T S application made clear that 01:55:24.878 --> 01:55:27.519 we will protect customers access to basic telephone 01:55:27.528 --> 01:55:30.668 service no matter where customers live, their income 01:55:30.677 --> 01:55:33.579 or their access to other forms of communication. Our 01:55:33.668 --> 01:55:36.739 rules were designed to provide that assurance and AT&T 01:55:36.749 --> 01:55:40.519 S application did not follow our rules. I'd like to 01:55:40.528 --> 01:55:44.398 address a few assertions uh that arose in the course 01:55:44.407 --> 01:55:48.249 of that proceeding. Um Just for again, framing for 01:55:48.258 --> 01:55:54.728 this uh oar for example, we heard from AT&T that um 01:55:56.418 --> 01:56:01.519 its relief from polar obligations was a necessary path 01:56:01.568 --> 01:56:04.798 to move forward with modernizing its network and bridging 01:56:04.809 --> 01:56:09.387 the digital divide. AT&T notably does not dispute that 01:56:09.398 --> 01:56:12.458 it is invested in and is continuing to invest in modernizing 01:56:12.467 --> 01:56:16.298 its network. Nothing in the color rules prevent AT&T 01:56:16.309 --> 01:56:19.708 or any color from meeting color obligations using another 01:56:19.717 --> 01:56:23.157 technology other than copper lines or from investing 01:56:23.168 --> 01:56:26.407 in other advanced technologies. The question is not 01:56:26.418 --> 01:56:30.048 what technology a caller may use to meet its obligations 01:56:30.059 --> 01:56:33.309 but rather whether a carrier is obligated to provide 01:56:33.318 --> 01:56:36.499 basic telephone service to anyone who requests it in 01:56:36.508 --> 01:56:40.148 their service territory. 01:56:40.148 --> 01:56:42.637 I'd also like to highlight that the existence at one 01:56:42.648 --> 01:56:46.548 point in time of other providers or an area does not 01:56:46.559 --> 01:56:49.789 necessarily and permanently fulfill the same purpose 01:56:49.798 --> 01:56:53.338 as our color rules carriers can and do change their 01:56:53.349 --> 01:56:56.999 service offerings. Some carriers rely on the infrastructure 01:56:57.008 --> 01:57:00.758 of others to offer service and their service may degrade 01:57:00.769 --> 01:57:03.398 if the carrier they rely on does not maintain its physical 01:57:03.407 --> 01:57:07.967 network, allowing AT&T s color withdrawal in certain 01:57:07.978 --> 01:57:11.008 areas based on existence of alternative voice service 01:57:11.019 --> 01:57:13.608 providers in those areas would not meet our existing 01:57:13.617 --> 01:57:17.079 rules and would not provide the same assurance of access 01:57:17.378 --> 01:57:21.657 to universal service as our rules provide, there are 01:57:21.668 --> 01:57:24.478 no callers other than AT&T in the service territories 01:57:24.489 --> 01:57:27.637 that they're seeking to exit. Thus, no one would be 01:57:27.648 --> 01:57:31.157 obligated to provide basic service and Californians 01:57:31.168 --> 01:57:33.798 could be left without telephone service in those areas 01:57:35.188 --> 01:57:38.427 I also want to note that we received extensive engagement 01:57:38.438 --> 01:57:41.137 from members of the public who overwhelmingly urged 01:57:41.148 --> 01:57:44.829 us to reject AT&T S application to be relieved of its 01:57:44.838 --> 01:57:49.289 coal obligations. We received over 5000 public comments 01:57:49.298 --> 01:57:52.588 on the application proceeding DACA and we held eight 01:57:52.599 --> 01:57:55.947 public participation hearings in three cities. And 01:57:55.958 --> 01:57:59.068 virtually with the last virtual hearing lasting over 01:57:59.079 --> 01:58:04.249 five hours until 1130 pm, drawing more than 5800 attendees 01:58:04.258 --> 01:58:08.717 and around 400 comments, numerous commenters at our 01:58:08.728 --> 01:58:12.008 live public participation hearings drove for hours 01:58:12.019 --> 01:58:14.289 to reach these hearings and make their voices heard 01:58:15.499 --> 01:58:18.548 Many commenters stated that alternative voice service 01:58:18.559 --> 01:58:20.849 such as cellular phone service or voice over internet 01:58:20.858 --> 01:58:24.048 protocol was either not available in their areas due 01:58:24.059 --> 01:58:26.688 to a lack of alternative service service providers 01:58:27.289 --> 01:58:30.099 or did not have reliable service that consistently 01:58:30.108 --> 01:58:34.137 enabled calls at home. Many commenters voiced concern 01:58:34.148 --> 01:58:36.717 about the reliability of alternative voice services 01:58:36.728 --> 01:58:40.338 during an emergency and expressed a desire for a landline 01:58:40.349 --> 01:58:44.108 during a disaster or emergency. Many commented that 01:58:44.117 --> 01:58:47.378 a 911 dispatcher would know the caller's exact location 01:58:47.387 --> 01:58:50.447 immediately on a landline, which is not necessarily 01:58:50.458 --> 01:58:54.367 the case on non landline service. We also heard from 01:58:54.378 --> 01:58:57.177 commenters who pointed to public safety messages they 01:58:57.188 --> 01:58:59.668 have heard during outages that they should use a landline 01:58:59.677 --> 01:59:04.249 to contact loved ones or public safety services. 01:59:04.249 --> 01:59:06.769 Some participants also shared their experience with 01:59:06.778 --> 01:59:09.878 and preference for landline features that assist communication 01:59:09.887 --> 01:59:12.418 for those that are disabled, hard of hearing or visually 01:59:12.427 --> 01:59:16.677 impaired. Many commenters including some who identify 01:59:16.688 --> 01:59:19.258 as seniors or caretakers and family members of seniors 01:59:19.269 --> 01:59:22.739 also expressed that there and their loved ones familiarity 01:59:22.749 --> 01:59:25.978 with the plain old telephone system made it easier 01:59:25.989 --> 01:59:28.048 for them to connect with their loved ones or to get 01:59:28.059 --> 01:59:30.599 help in an emergency rather than using a cell phone 01:59:30.608 --> 01:59:34.258 that they may not be as comfortable with. Other commenters 01:59:34.269 --> 01:59:36.717 expressed frustration regarding their customer service 01:59:36.728 --> 01:59:39.999 experience with AT&T when experiencing poor service 01:59:40.008 --> 01:59:43.657 quality during storms and service outages and express 01:59:43.668 --> 01:59:47.769 a difficulty in retaining plain old telephone service 01:59:47.778 --> 01:59:51.947 when communicating with AT&T S customer service. While 01:59:51.958 --> 01:59:54.579 these public comments were not dispositive, they certainly 01:59:54.588 --> 01:59:57.867 provide valuable insight into the tensions and concerns 01:59:58.039 --> 01:59:59.878 that members of the public hold. 01:59:59.887 --> 02:00:03.147 And we evaluate color obligations of not just AT&T 02:00:03.156 --> 02:00:06.217 but of any color and when reexamining the color rules 02:00:06.227 --> 02:00:11.287 in this rule making, um Before I turn it over to other 02:00:11.297 --> 02:00:13.656 commissioners for comments and back to President Reynolds 02:00:13.666 --> 02:00:16.266 I do want to thank and recognize a number of people 02:00:16.277 --> 02:00:19.617 for the tremendous amount of work and the application 02:00:19.628 --> 02:00:21.597 proceeding and development of the order instituting 02:00:21.606 --> 02:00:24.336 rule making and the efforts in engaging with as many 02:00:24.347 --> 02:00:27.077 Californians as possible on this important issue. Um I agree that 02:03:08.186 --> 02:03:10.838 ensuring a caller for hard to reach areas of the state 02:03:10.847 --> 02:03:14.597 is critical to ensuring universal service for all Californians 02:03:15.007 --> 02:03:18.447 As was mentioned AT&T filed an application to be relieved 02:03:18.458 --> 02:03:22.547 of its caller obligations across wide swaths of California 02:03:22.588 --> 02:03:26.618 This was um discussed by Commissioner Reynolds and 02:03:26.628 --> 02:03:30.067 the application um was subject to significant debate 02:03:30.077 --> 02:03:34.088 We received comments that um assumed maintaining a 02:03:34.097 --> 02:03:37.027 caller obligation would somehow prevent the caller 02:03:37.037 --> 02:03:40.148 from updating their system with new technology in their 02:03:40.156 --> 02:03:42.697 service territory. I just want to reiterate what um 02:03:42.708 --> 02:03:45.656 Commissioner Reynolds said that the current caller 02:03:45.666 --> 02:03:48.368 rules do not prevent a caller from upgrading their 02:03:48.378 --> 02:03:51.178 facilities or modernizing infrastructure within their 02:03:51.186 --> 02:03:56.246 service territory. Um Earlier today, we dismissed AT&T 02:03:56.257 --> 02:03:59.757 S application. However, by initiating this rule making 02:03:59.767 --> 02:04:02.746 we also recognize that communications landscape has 02:04:02.757 --> 02:04:05.458 changed significantly since the last update to the 02:04:05.466 --> 02:04:08.781 caller rules. Um while the technologies that people 02:04:08.791 --> 02:04:11.902 rely on change we want to ensure that our guiding principles 02:04:11.912 --> 02:04:15.162 remain those of universal service, ensuring the availability 02:04:15.172 --> 02:04:18.322 of affordable reliable communication services that 02:04:18.332 --> 02:04:21.491 will function for all Californians. The rule making 02:04:21.503 --> 02:04:24.122 we're initiating today will consider whether and how 02:04:24.132 --> 02:04:26.983 to revise our call rules. In addition to determining 02:04:26.991 --> 02:04:29.642 whether the collar rules are still necessary, we'll 02:04:29.652 --> 02:04:33.406 determine whether other services, other service providers 02:04:33.418 --> 02:04:36.926 such as VoIP or wire wireless providers can be callers 02:04:37.067 --> 02:04:39.628 We do not undertake this rule making lightly and I 02:04:39.637 --> 02:04:42.147 understand that many people in California are still 02:04:42.156 --> 02:04:46.228 reliant on wired service and any changes that we make 02:04:46.236 --> 02:04:49.156 to the caller rules will be thoroughly considered. 02:04:49.168 --> 02:04:51.716 And the principles again, of universal service are 02:04:51.728 --> 02:04:55.337 top of mind for all of us. So 02:06:37.806 --> 02:06:41.207 um as as I noted, I support this and look forward to 02:06:41.216 --> 02:06:46.098 seeing the rule making um uh progress. Thank you. Um I am supportive 02:06:49.788 --> 02:06:53.288 of this new OIR and I just wanted to emphasize a couple 02:06:53.298 --> 02:06:56.567 of things especially um the comments made by Commissioner 02:06:56.577 --> 02:07:01.616 Reynolds. Um As you heard the Cola rules safeguard 02:07:01.628 --> 02:07:04.777 telephone service by ensuring Californians have access 02:07:04.788 --> 02:07:07.716 to at least one telephone company that offers reliable 02:07:07.728 --> 02:07:13.257 service access to 911 customer protections and um offer 02:07:13.267 --> 02:07:16.288 affordable service through the state's lifeline program 02:07:16.926 --> 02:07:20.437 Um I wanted to recognize that the companies that serve 02:07:20.447 --> 02:07:24.267 as callers are essential to ensuring universal telephone 02:07:24.277 --> 02:07:28.187 service, especially in our rural areas of California 02:07:28.298 --> 02:07:32.507 with limited or no alternative providers. Um And I 02:07:32.517 --> 02:07:35.788 also think it's important to to just note that we do 02:07:35.798 --> 02:07:39.306 subsidize the callers through our high cost fund programs 02:07:39.317 --> 02:07:42.187 to offset the cost of providing service in these remote 02:07:42.197 --> 02:07:47.267 areas. Um The rules reflect the public's expectation 02:07:47.277 --> 02:07:51.827 that all use utility services be dependable and we 02:07:51.837 --> 02:07:54.587 have heard significant support for these protections 02:07:54.598 --> 02:07:58.548 from the public, elected officials and emergency responders 02:08:00.197 --> 02:08:02.788 But many things have also changed. Commissioner, uh 02:08:02.798 --> 02:08:05.497 Reynolds walked us through a little bit of the history 02:08:05.507 --> 02:08:10.257 Um The telecom, it changes have occurred in the telecom 02:08:10.267 --> 02:08:13.548 industry since the rules were enacted. Uh nearly 30 02:08:13.556 --> 02:08:16.858 years ago, we know that many people have shifted from 02:08:16.866 --> 02:08:21.168 landline service um to cell phone service and uh cell 02:08:21.176 --> 02:08:24.466 phone service has become ubiquitous. Additionally, 02:08:24.478 --> 02:08:28.517 newer technologies such as cable, fiber and fixed wireless 02:08:28.527 --> 02:08:32.068 and satellite offer competitive services to the traditional 02:08:32.078 --> 02:08:36.718 large monopoly telephone companies.
