WEBVTT 00:00:03.409 --> 00:00:08.393 Morning and welcome. I'm calling the 00:00:08.405 --> 00:00:13.313 California Public Utilities Commission Business Meeting 00:00:13.325 --> 00:00:18.491 of December 5th, 2019. Public agenda Number 3452 to order. 00:00:18.503 --> 00:00:23.066 Everyone, please rise for the Pledge of Allegiance. 00:00:23.091 --> 00:00:27.997 I pledge allegiance to the flag of the United 00:00:28.009 --> 00:00:32.703 States of America and to the Republic for which it stands, one 00:00:32.715 --> 00:00:37.627 nation under God, indivisible, liberty and justice for all. Thank 00:00:37.639 --> 00:00:42.638 you. Robert. Would you please play the safety announcement for us? 00:00:42.663 --> 00:00:46.940 As you're aware, our number one priority is safety. 00:00:46.952 --> 00:00:51.182 As such, we will address certain safety concerns in this venue. In the 00:00:51.194 --> 00:00:55.417 event of an emergency, please calmly proceed toward the exits. We have 00:00:55.429 --> 00:00:59.664 four exits, two in the rear and one on either side of the dais. In the 00:00:59.676 --> 00:01:04.195 event we need to evacuate the building, our assembly point is in the Garden 00:01:04.207 --> 00:01:08.440 Plaza area between the War Memorial Herbs Theater and the War Memorial 00:01:08.452 --> 00:01:12.559 Opera House on Van Ness. When going out the rear exits, head through 00:01:12.571 --> 00:01:16.809 the courtyard and down the front steps, then head south on Van Ness by 00:01:16.821 --> 00:01:20.973 crossing McAllister Street. You'll find the Garden Plaza area on your 00:01:20.985 --> 00:01:25.387 right immediately after walking past the Herbs Theater. When going up the 00:01:25.399 --> 00:01:29.796 side exits after heading out either exits, you'll find yourself on Golden 00:01:29.808 --> 00:01:33.799 Gate Avenue. From there, proceed East turned south on Van ness and 00:01:33.811 --> 00:01:37.966 walk towards McAllister Street. After crossing McAllister, the Garden 00:01:37.978 --> 00:01:42.145 Plaza area will be on your right after passing the War Memorial Herbs 00:01:42.157 --> 00:01:46.496 Theater. In the event of an emergency, Executive Director Alice Stebbins 00:01:46.508 --> 00:01:50.860 will call 911, and our public advisor, Alison Brown, is certified in CPR 00:01:50.860 --> 00:01:55.413 and first aid. Thank you for your attention. 00:01:55.438 --> 00:02:00.270 Okay, Thank you. We will now turn to the public 00:02:00.270 --> 00:02:03.100 comment section of our 00:02:03.112 --> 00:02:06.152 agenda. The Commission provides three minutes 00:02:06.164 --> 00:02:09.199 to each speaker. There will be a sign held up 00:02:09.211 --> 00:02:12.191 in front of you to alert you have one minute 00:02:12.203 --> 00:02:15.367 remaining. If you have written comments, please 00:02:15.379 --> 00:02:18.423 hand them to Deputy Executive Director Edward 00:02:18.435 --> 00:02:21.738 Randolph, here in the front. The Commission rules 00:02:21.750 --> 00:02:24.601 do not allow for parties in proceedings to 00:02:24.613 --> 00:02:27.568 speak about open proceedings. The public can 00:02:27.580 --> 00:02:30.614 make comments addressing items on consent and 00:02:30.626 --> 00:02:33.720 regular agendas and including items not on the 00:02:33.732 --> 00:02:36.639 agenda. Please note that there will be will 00:02:36.651 --> 00:02:39.808 not be public comment on any item on the closed 00:02:39.820 --> 00:02:42.725 session agenda today. With that guidance in 00:02:42.737 --> 00:02:45.635 mind, I welcome today speakers. Please come 00:02:45.647 --> 00:02:48.690 up to the podium. When I call your name, I'll 00:02:48.690 --> 00:02:51.376 call the first name and then the 00:02:51.388 --> 00:02:54.340 person behind that name, so they could be ready to also go 00:02:54.340 --> 00:03:00.154 to the podium. First will 00:03:00.166 --> 00:03:05.612 be Clinton Oliver, followed by Suzanne Kim. 00:03:07.837 --> 00:03:11.538 Good Morning, Commissioners, and thank you 00:03:11.550 --> 00:03:15.325 for the opportunity to comment. My name is Clint Olivier and 00:03:15.337 --> 00:03:18.920 I represent Biz Fed Central Valley, a grassroots alliance 00:03:18.932 --> 00:03:22.589 of more than 50 businesses and organizations, representing 00:03:22.601 --> 00:03:26.243 20,000 employers and over 300,000 employees in the Central 00:03:26.255 --> 00:03:30.033 Valley of California. Biz Fed Central Valley brings together 00:03:30.045 --> 00:03:33.258 associations and employers large and small to share 00:03:33.270 --> 00:03:37.178 information, expertise, connections and research. We believe a 00:03:37.190 --> 00:03:41.017 thriving economy will help solve many of the Central Valley's 00:03:41.029 --> 00:03:45.053 entrance, entrench, entrenched challenges like high concentrated 00:03:45.065 --> 00:03:48.526 poverty, where tens of thousands of families are forced 00:03:48.538 --> 00:03:52.134 to choose between buying gasoline or groceries each week. 00:03:52.146 --> 00:03:55.418 Many of our member businesses currently rely on high 00:03:55.430 --> 00:03:59.333 efficiency natural gas equipment to cost-effectively run their 00:03:59.345 --> 00:04:03.429 operations and to comply with stringent air quality and emissions 00:04:03.441 --> 00:04:06.854 regulations. Moving toward electrification would cause 00:04:06.866 --> 00:04:10.625 businesses to shoulder thousands of dollars in new equipment 00:04:10.637 --> 00:04:14.099 costs. Presently, many businesses struggle to pay their 00:04:14.111 --> 00:04:18.187 electric bills in individual households as well. High electricity 00:04:18.199 --> 00:04:21.791 costs are part of the problem. When state decision-makers 00:04:21.803 --> 00:04:25.194 speak about electrification, they often emphasize how, 00:04:25.206 --> 00:04:28.856 over time, it would lead to lower energy bills. But what's 00:04:28.868 --> 00:04:32.203 often overlooked are the staggering up-front costs of 00:04:32.215 --> 00:04:36.182 converting existing homes to all-electric end uses so residents 00:04:36.194 --> 00:04:40.079 can, at some later date, see lower energy bills. A recent CBIA 00:04:40.091 --> 00:04:43.802 study suggests that it would cost about $7000 per household 00:04:43.814 --> 00:04:47.024 to replace existing natural gas appliances and make 00:04:47.036 --> 00:04:50.753 necessary electrical upgrades to accommodate increased load 00:04:50.765 --> 00:04:54.901 and ensure public safety. The costs for businesses is even higher. 00:04:54.913 --> 00:04:58.566 Our concern is that in advancing building electrification, 00:04:58.578 --> 00:05:02.100 you may saddle those already struggling financially with 00:05:02.112 --> 00:05:05.460 additional expenses they just can't afford. We cannot 00:05:05.460 --> 00:05:10.276 afford a one size fits all solution. California's 00:05:10.288 --> 00:05:14.180 want and need energy choice. Thank you, Commissioners. 00:05:14.180 --> 00:05:17.358 Thank you, Mr. Olivier. 00:05:17.370 --> 00:05:20.705 Next, Suzanne Kim, followed by Michael Picker. 00:05:20.730 --> 00:05:22.880 Hi, Commissioners. Thank 00:05:22.880 --> 00:05:26.377 you so much for this opportunity. 00:05:26.389 --> 00:05:29.254 My name is Suzanne Kim, and I come as a 00:05:29.266 --> 00:05:32.842 mother impacted by the recent public safety power 00:05:32.854 --> 00:05:36.011 shutdowns. And I had come as a professional 00:05:36.023 --> 00:05:39.094 who actually works in EJ issues and trying 00:05:39.106 --> 00:05:42.188 to bring solar and discounted solar to low 00:05:42.200 --> 00:05:45.564 income communities of color. We did everything 00:05:45.576 --> 00:05:48.808 right. You know, our house, we've got solar, 00:05:48.820 --> 00:05:52.032 we got, you know, most of the appliances are 00:05:52.044 --> 00:05:55.341 electric. We have electric vehicles. In terms 00:05:55.353 --> 00:05:58.715 of emergency, we have, you know, the 50 gallon 00:05:58.727 --> 00:06:01.670 drums. We have a go kit. We have several 00:06:01.682 --> 00:06:04.969 go kits. We have tons of, you know, emergency 00:06:04.981 --> 00:06:08.209 equipment readily available and in locations 00:06:08.221 --> 00:06:11.658 throughout the house in case something happens. 00:06:11.670 --> 00:06:14.544 But there was, I think, some unintended 00:06:14.556 --> 00:06:17.840 consequences that happened as a result of the 00:06:17.852 --> 00:06:21.147 shutdown. And I come here with three concrete 00:06:21.159 --> 00:06:24.521 suggestions as to what could be done. First, I 00:06:24.533 --> 00:06:27.763 live in Tiburon, California, and I recognize 00:06:27.775 --> 00:06:30.989 it's a relatively affluent area. However, in 00:06:31.001 --> 00:06:34.084 the past couple of years, AT&T has removed 00:06:34.096 --> 00:06:37.389 landline access to my community. In addition, 00:06:37.401 --> 00:06:40.418 I do not have cell phone reception. So in 00:06:40.430 --> 00:06:43.572 this particular case, I had no opportunity, 00:06:43.584 --> 00:06:46.665 no way, no means of communicating. Now, my 00:06:46.677 --> 00:06:50.112 option is, you know, right now, buy a satellite 00:06:50.124 --> 00:06:53.355 telephone, that's not really a viable option 00:06:53.367 --> 00:06:56.512 for me. So I had no way of communicating or 00:06:56.524 --> 00:06:59.896 figuring out what was going on. Even if I had, 00:06:59.908 --> 00:07:03.058 even if I had a power back up, there was no 00:07:03.070 --> 00:07:06.376 way to call anybody because I don't have, you 00:07:06.388 --> 00:07:09.597 know, you know, even with a VoIP phone call, 00:07:09.609 --> 00:07:12.830 you can't, you can't use that if the Comcast 00:07:12.842 --> 00:07:16.344 goes down. So first there should be a regulation 00:07:16.356 --> 00:07:19.225 saying that if you want to be a telecom 00:07:19.237 --> 00:07:22.664 provider, you cannot, you know, redline or even 00:07:22.676 --> 00:07:25.829 greenline communities, no matter what, like 00:07:25.841 --> 00:07:29.131 you have to have access to landlines and-or a 00:07:29.143 --> 00:07:32.301 cell phone access, cell phone tower in that 00:07:32.313 --> 00:07:35.094 area. If you want to provide energy and 00:07:35.106 --> 00:07:39.045 communications to a certain area. That was one issue. 00:07:39.057 --> 00:07:42.489 I've been calling the CPUC. I have been calling 00:07:42.501 --> 00:07:45.515 everyone I know for the past couple years 00:07:45.527 --> 00:07:48.597 trying to get a landline. I can't get one. 00:07:48.609 --> 00:07:52.050 Second, restrooms. I live in a place with hill, 00:07:52.062 --> 00:07:55.425 so we could not, it requires a sewage ejection 00:07:55.437 --> 00:07:58.310 unit every time I go to the bathroom or 00:07:58.322 --> 00:08:01.675 use water. I had access to none of that during 00:08:01.687 --> 00:08:04.837 the, during that. And the facilities nearby 00:08:04.849 --> 00:08:08.137 also did not provide that. They provided cell 00:08:08.149 --> 00:08:11.233 phone charging stations, but no bathrooms. 00:08:11.245 --> 00:08:14.458 No showers. Nothing like that. The third, is 00:08:14.470 --> 00:08:17.767 that everyone, because it's cheaper, used gas 00:08:17.779 --> 00:08:20.854 powered generators. We should require PG&E 00:08:20.866 --> 00:08:24.097 if they want to do these shutdowns to offset 00:08:24.109 --> 00:08:27.536 those emissions. Because those were significant 00:08:27.548 --> 00:08:30.843 during that shutdown. And those are the three 00:08:30.855 --> 00:08:34.001 comments, I guess I have for right now. The 00:08:34.013 --> 00:08:37.242 fourth is you know, I should have batteries, 00:08:37.254 --> 00:08:40.612 but let me tell you the cost. I've been quoted 00:08:40.624 --> 00:08:43.563 25 to $30,000 just to have my sewage, my 00:08:43.575 --> 00:08:46.939 refrigerator. That is prohibitively expensive. 00:08:46.951 --> 00:08:50.040 So I'm just telling you that batteries are 00:08:50.040 --> 00:08:55.728 still not really a viable option. Thank you. 00:08:55.753 --> 00:08:59.141 Thank you, Miss Kim. Mr. Picker. 00:09:04.600 --> 00:09:08.811 Thank you. I'm Michael Picker. I am here 00:09:08.823 --> 00:09:13.189 for a very brief but difficult purpose, which is to tell you 00:09:13.201 --> 00:09:17.562 all how deeply saddened I am by the passing of Edgar Hansen. 00:09:17.574 --> 00:09:21.946 And Edgar and Robert and the rest of the AV crew have worked 00:09:21.958 --> 00:09:26.315 very hard to try to make our task as Commissioners easier to 00:09:26.327 --> 00:09:30.840 explain to our colleagues and to the public what our votes are 00:09:30.852 --> 00:09:35.359 and why. And I deeply appreciated their many kindnesses, their 00:09:35.371 --> 00:09:39.388 efforts to try to deal with my soft voice and mumbling. 00:09:39.400 --> 00:09:43.684 And so it was both shocking and difficult to accept that he 00:09:43.696 --> 00:09:47.849 passed, he passed, actually, here on the job, serving the 00:09:47.861 --> 00:09:52.294 state of California and the people. So I just wanted to share 00:09:52.306 --> 00:09:56.537 that with all of you. And since, I mean, we're all here, I 00:09:56.549 --> 00:10:00.907 just want to thank everybody else who's also worked hard and 00:10:00.919 --> 00:10:05.362 performed their jobs under difficult circumstances. On behalf 00:10:05.374 --> 00:10:09.811 of the people, the state of California, I continue to cherish 00:10:09.823 --> 00:10:13.769 the opportunity to work with all of you. So thank you. 00:10:13.795 --> 00:10:17.516 Thank you, President Picker. 00:10:24.245 --> 00:10:28.450 Thank you very much, President Picker. We so 00:10:28.462 --> 00:10:33.069 appreciate you sharing your feelings today. We're struggling daily with 00:10:33.069 --> 00:10:36.823 the loss of Edgar. And we thank 00:10:36.835 --> 00:10:40.529 you very much for your comments and your continued 00:10:40.541 --> 00:10:44.046 support. Thank you. Again, I'd like to thank the 00:10:44.058 --> 00:10:47.360 speakers who have come today and shared their 00:10:47.360 --> 00:10:49.923 concerns with us. Is there anyone 00:10:49.935 --> 00:10:52.509 else in the, yes, sir? Would you like to come forward? 00:10:52.509 --> 00:10:54.961 And please state your name. 00:10:54.986 --> 00:10:56.729 Good morning, 00:10:56.741 --> 00:10:59.470 Commissioners. And thank you for allowing 00:10:59.470 --> 00:11:02.007 me to speak today. I'm Art 00:11:02.019 --> 00:11:04.755 Bagget, President of the board of directors 00:11:04.767 --> 00:11:07.185 of the Civic Forest Watershed Lands and 00:11:07.197 --> 00:11:10.001 Stewardship Council. I've been on the board 00:11:10.013 --> 00:11:12.429 since its inception, set in 2004. First 00:11:12.441 --> 00:11:15.117 is the chair of the State Waterboard. And 00:11:15.129 --> 00:11:17.737 then, since 2013, I've been honored to be 00:11:17.749 --> 00:11:20.307 one of the three public members that the 00:11:20.319 --> 00:11:22.671 Commission appoints. I'm here to speak 00:11:22.683 --> 00:11:25.669 regarding the proposed tribal land policy, and 00:11:25.681 --> 00:11:28.038 we went to acknowledge and applaud the 00:11:28.050 --> 00:11:30.794 Commission's efforts to finally advance of 00:11:30.806 --> 00:11:33.472 meaningful policy, which, with connections 00:11:33.484 --> 00:11:36.100 and outcomes, would be beneficial for the 00:11:36.112 --> 00:11:38.784 California tribal communities. And we look 00:11:38.796 --> 00:11:41.230 forward to working with the Commission 00:11:41.242 --> 00:11:43.905 and with the, to help develop the guidance 00:11:43.917 --> 00:11:46.591 and promulgate regulations that, you know, 00:11:46.603 --> 00:11:49.271 will be necessary to implement the policy. 00:11:49.283 --> 00:11:51.776 We're created, just a quick background, 00:11:51.788 --> 00:11:54.080 we were created to implement the PG&E 00:11:54.092 --> 00:11:56.769 Lands Conservation. According to the 2003 00:11:56.781 --> 00:11:59.515 bankruptcy of PG&E settlement, and the CPUC 00:11:59.527 --> 00:12:01.960 approved the settlement agreement that 00:12:01.972 --> 00:12:04.573 requires conservation easements be placed 00:12:04.585 --> 00:12:07.012 on PG&E watershed lands to protect the 00:12:07.024 --> 00:12:09.756 beneficial public values. Due to these land 00:12:09.768 --> 00:12:12.200 conservation commitments, a portion of 00:12:12.212 --> 00:12:14.755 PG&E lands are also donated to qualified 00:12:14.767 --> 00:12:17.508 public and nonprofit entities. We have gone 00:12:17.520 --> 00:12:19.881 to great lengths to ensure that tribe, 00:12:19.893 --> 00:12:22.702 tribal communities, that local governments, 00:12:22.714 --> 00:12:27.747 state and federal land agencies have had meaningful opportunities to receive the 00:12:27.759 --> 00:12:30.487 benefits of these lands and ensure that all 00:12:30.499 --> 00:12:32.990 cultural resources are protected by the 00:12:33.002 --> 00:12:35.976 easements placed upon the PG&E watershed lands. 00:12:35.988 --> 00:12:38.601 We're in the final stages of implementing 00:12:38.613 --> 00:12:43.538 this long and lengthy process. We have 13 qualified entities holding easements 00:12:43.550 --> 00:12:46.274 over the 140,000 acres of PGE Land. We have 00:12:46.286 --> 00:12:48.710 14 entities that are holding easements 00:12:48.722 --> 00:12:53.645 over the 40,000 lands, which have been up for fee title donation. The CPUC has 00:12:53.657 --> 00:12:56.197 approved 59 advice letters that PG&E has 00:12:56.209 --> 00:12:58.947 filed to implement the recommendations, and 00:12:58.959 --> 00:13:01.630 there's still 39 advice letters remaining. 00:13:01.642 --> 00:13:04.137 We have developed a schedule which will 00:13:04.149 --> 00:13:06.872 call for us to be basically finished by the 00:13:06.884 --> 00:13:09.370 end of the 2020. The board will be have 00:13:09.382 --> 00:13:11.737 acted upon all of the transactions. It 00:13:11.749 --> 00:13:14.490 will probably take another nine months for 00:13:14.502 --> 00:13:17.290 the staff and PG&E to get the advice letters 00:13:17.302 --> 00:13:19.604 to the Commission. So by the end of, 00:13:19.616 --> 00:13:22.223 in less than two years, we will be out of 00:13:22.235 --> 00:13:24.792 business. We have the budget to do that, 00:13:24.804 --> 00:13:27.715 but not to do much, but we have the sufficient 00:13:27.727 --> 00:13:29.965 funds to complete our work on these 00:13:29.977 --> 00:13:32.770 remaining fee title donations and easements. 00:13:32.782 --> 00:13:35.026 And we just look forward to working 00:13:35.038 --> 00:13:37.392 with the Commission, working with your 00:13:37.404 --> 00:13:40.143 staff and our staff to help any way we can 00:13:40.155 --> 00:13:43.013 develop guidance and regulations to implement 00:13:43.025 --> 00:13:45.459 the policy. If you have any questions, 00:13:45.459 --> 00:13:48.568 we're always available to help answer this. 00:13:48.593 --> 00:13:50.810 Okay, Thank you very much. Appreciate that. 00:13:50.810 --> 00:13:56.044 Is there anyone else? Yes. 00:13:56.056 --> 00:14:01.079 Please come forward. Please. State your name. 00:14:01.079 --> 00:14:03.154 Good morning. I'm 00:14:03.166 --> 00:14:05.761 Christina Snyder, I'm the tribal adviser for 00:14:05.773 --> 00:14:08.475 Governor Gavin Newsom. Good morning, President. 00:14:08.487 --> 00:14:10.693 Thank you for having me. Good morning, 00:14:10.705 --> 00:14:13.235 Commissioners. Thank you for having me. Last 00:14:13.247 --> 00:14:15.619 time I came before you was to support the 00:14:15.631 --> 00:14:18.054 tribal lands transfer policy, and I'm here 00:14:18.066 --> 00:14:20.387 again to support and applaud the efforts 00:14:20.399 --> 00:14:22.815 of the Commission to adopt this policy. I, 00:14:22.827 --> 00:14:25.254 last time I was here, I mentioned that, if 00:14:25.266 --> 00:14:27.687 you adopted this, it would be in line with 00:14:27.699 --> 00:14:30.189 some things that were coming down the road. 00:14:30.201 --> 00:14:32.619 And I think about two weeks later was when 00:14:32.631 --> 00:14:34.892 the Governor rolled out Executive Order 00:14:34.904 --> 00:14:37.101 N1519 apologizing for the genocide that 00:14:37.113 --> 00:14:39.720 happened at the creation and the early times 00:14:39.732 --> 00:14:42.312 of this state. What this land transfer policy 00:14:42.324 --> 00:14:44.916 does is completely in line with the direction 00:14:44.928 --> 00:14:47.402 that Governor Newsom wants to see the state 00:14:47.414 --> 00:14:49.504 going in acknowledging and hopefully 00:14:49.516 --> 00:14:51.930 repairing some of the damage that was done 00:14:51.942 --> 00:14:54.594 early on. In order to restore the relationship 00:14:54.606 --> 00:14:56.743 between tribes and state leadership so 00:14:56.755 --> 00:14:59.187 that we can move forward in a progressive 00:14:59.199 --> 00:15:01.386 partnership based on honesty and mutual 00:15:01.398 --> 00:15:03.822 respect. So I just wanted to applaud your 00:15:03.834 --> 00:15:06.366 efforts. I think this is amazing step and so 00:15:06.378 --> 00:15:08.865 that you know, I am advising agency-wide to 00:15:08.877 --> 00:15:13.335 start adopting things that are modeled off of this policy. So you are actually 00:15:13.347 --> 00:15:15.825 trailblazing in this space, and it's really 00:15:15.837 --> 00:15:18.384 exciting to see. So thank you for having me. 00:15:18.409 --> 00:15:19.589 Thank you 00:15:19.589 --> 00:15:26.403 for being here today, Cristina. Is there anyone 00:15:26.415 --> 00:15:33.342 else in the audience who would like to address the Commission today? 00:15:33.354 --> 00:15:40.175 Okay. Seeing none, the public comment period is now closed. We will 00:15:40.187 --> 00:15:46.818 move on in the agenda to those items. These, and I will call them 00:15:46.830 --> 00:15:53.848 out, these are the following changes to today's agenda. Item two will 00:15:53.860 --> 00:16:00.690 be held until 12-19-19. Item three will be held until 1-16-20. Item 00:16:00.702 --> 00:16:07.827 five will be held until 12-19-19. Item 13 will be held until 12-19-19. 00:16:07.839 --> 00:16:14.272 Item 23 will be held until 12-19-19. Item 26 will be held until 00:16:14.284 --> 00:16:21.087 12-19-19. Item 27 will be held until 12-19-19. Item 31 will be held 00:16:21.099 --> 00:16:28.015 until 12-19-19. Item 37 will be held until 12-19-19. Item 39 will be 00:16:28.027 --> 00:16:34.636 held until 12-19-19. Item 47 will be held until 1-16-20. Item 47A 00:16:34.648 --> 00:16:41.670 will be held until 1-16-20. Item 48, take up with the Consent Agenda. 00:16:41.682 --> 00:16:48.388 Item 49 will also be taken up with the Consent Agenda. Item 50 has 00:16:48.400 --> 00:16:55.419 been withdrawn. Item 50A has been withdrawn. Item 51 will be taken up 00:16:55.431 --> 00:17:02.544 with the consent agenda. And item 61 will be taken up with the consent 00:17:02.556 --> 00:17:09.180 agenda. We will take up the consent items now. Is there a motion? 00:17:09.180 --> 00:17:11.608 So moved. 00:17:11.633 --> 00:17:17.235 It has been moved and seconded. All 00:17:17.247 --> 00:17:22.861 in favor of the Consent Agenda. Say aye. Thank you. The 00:17:22.873 --> 00:17:28.230 consent items have been passed unanimously. Are there 00:17:28.242 --> 00:17:33.811 any comments on any of the items on the consent agenda? 00:17:33.836 --> 00:17:37.911 Yes, I'd like to comment on Item 48. 00:17:37.923 --> 00:17:41.944 That is a decision that set out frameworks for two important 00:17:41.956 --> 00:17:46.367 topics in energy efficiency. It addresses regional energy networks 00:17:46.379 --> 00:17:50.341 and a new market transformation initiative. Regional energy 00:17:50.353 --> 00:17:54.497 networks were authorized by a previous Commission decision and 00:17:54.509 --> 00:17:58.401 are set up by local governments to bring energy efficiency 00:17:58.413 --> 00:18:02.695 measures to hard to reach customers, ensure code compliance, and 00:18:02.707 --> 00:18:06.671 deliver energy efficiency to municipal buildings. This is a 00:18:06.683 --> 00:18:11.023 unique role and was intended to fill a gap that we saw in Utility 00:18:11.035 --> 00:18:14.860 and CCA portfolios. RENs have now moved from the original 00:18:14.872 --> 00:18:18.691 pilot status and there are now a permanent part of the EE 00:18:18.703 --> 00:18:23.193 marketplace. RENs do have some challenges and some successes, which 00:18:23.205 --> 00:18:27.153 are partly a consequence of the fact that energy efficiency 00:18:27.165 --> 00:18:31.521 itself is in a period of transition. But in the framework we just 00:18:31.533 --> 00:18:35.618 adopted, we reaffirmed that RENs should continue and grow and 00:18:35.630 --> 00:18:39.596 that new ones may form, but under additional guidance. This 00:18:39.608 --> 00:18:43.943 guidance will require ongoing filing and review of their business 00:18:43.955 --> 00:18:47.907 plans and seek to minimize overlap with utilities and CCA's 00:18:47.919 --> 00:18:52.063 energy efficiency programs. The second topic we address in the 00:18:52.075 --> 00:18:56.297 decision is a market transformation initiative. As we discussed 00:18:56.309 --> 00:19:00.713 this past August, when we voted on the energy efficiency potential 00:19:00.725 --> 00:19:04.416 and goal study. Right now, we're going through a period 00:19:04.428 --> 00:19:08.839 where were benefiting from California's energy efficiency success, 00:19:08.851 --> 00:19:12.746 which means we're also having to take stock and figure out 00:19:12.758 --> 00:19:16.831 how to bring the next wave of success. The initiative we just 00:19:16.843 --> 00:19:21.060 approved is one way of finding that next wave. We set up a five 00:19:21.072 --> 00:19:25.086 year, $250 million program and guidance for an administrator 00:19:25.098 --> 00:19:29.057 that will solicit, evaluate, and fund market transformation 00:19:29.069 --> 00:19:33.211 ideas. While it will be some time before we start to see those 00:19:33.223 --> 00:19:37.444 initial ideas presented and transforming the market in the same 00:19:37.456 --> 00:19:41.604 way that passed measures have, I'm very excited about this new 00:19:41.616 --> 00:19:45.578 initiative and I thank you for your support in adopting it. 00:19:45.603 --> 00:19:48.372 Thank you, Commissioner 00:19:48.384 --> 00:19:50.976 Randolph. Any other Commissions to speak 00:19:50.988 --> 00:19:53.637 on the consent agenda? Okay, I would like 00:19:53.649 --> 00:19:56.373 to make some brief comments regarding Item 00:19:56.385 --> 00:19:59.094 49. SDG&E's energy management plan for the 00:19:59.106 --> 00:20:01.700 San Diego Port District. This has been a 00:20:01.712 --> 00:20:04.173 challenging decision as it is balancing 00:20:04.185 --> 00:20:06.976 three competing and opposing requirements. 00:20:06.988 --> 00:20:09.695 We need to reduce error emissions from the 00:20:09.707 --> 00:20:12.237 berthing ships and the greenhouse gases 00:20:12.249 --> 00:20:14.962 they produce. We also need a solution that 00:20:14.974 --> 00:20:17.383 addresses the realities of the cruise 00:20:17.395 --> 00:20:22.332 industry and the sustainable economic growth for the San Diego region. And we 00:20:22.344 --> 00:20:24.998 need to minimize cross subsidies and find 00:20:25.010 --> 00:20:27.485 an equitable outcome for ratepayers. I 00:20:27.497 --> 00:20:29.946 commend ALJ Elaine Lao for doing such a 00:20:29.958 --> 00:20:32.736 masterful job on balancing these important 00:20:32.748 --> 00:20:35.457 and opposing goals. Following the guidance 00:20:35.469 --> 00:20:38.063 of Assembly Bill 628, ALJ Lao's proposed 00:20:38.075 --> 00:20:40.970 decision results in an outcome that I believe 00:20:40.982 --> 00:20:43.447 is workable for everyone. I especially 00:20:43.459 --> 00:20:48.146 appreciate ALJ Lao's PD revisions. I'm encouraged that the parties show a 00:20:48.158 --> 00:20:50.736 willingness to get back to the table, to 00:20:50.748 --> 00:20:53.464 work out a long-term maritime rate for the 00:20:53.476 --> 00:20:56.313 port and to bring it back to the Commission. 00:20:56.325 --> 00:20:58.920 I also want to recognize Assistant Chief 00:20:58.932 --> 00:21:04.118 ALJ Gene McKinney, who's strong guidance helped us get to the finish line, and Ed 00:21:04.130 --> 00:21:06.843 Randolph, Paul Phillips, and Edgy So Busan 00:21:06.855 --> 00:21:09.390 from the Energy Division for their hard 00:21:09.390 --> 00:21:14.809 work on this matter. And I ask for 00:21:14.821 --> 00:21:20.152 your support and thank you. Any other comments? Okay, 00:21:20.164 --> 00:21:25.049 we will then move on to the regular agenda items, 00:21:25.061 --> 00:21:30.741 starting with item number 52. Commissioner Guzman Aceves. 00:21:30.766 --> 00:21:34.797 Thank you. I want 00:21:34.809 --> 00:21:38.768 to start by acknowledging President Picker for 00:21:38.780 --> 00:21:42.775 the kind remarks today. And also for forcing me 00:21:42.787 --> 00:21:46.710 to present on five extensions is this morning. 00:21:46.710 --> 00:21:51.065 Okay, so the 00:21:51.077 --> 00:21:55.546 first one is, I have four in a row here, so 00:21:55.571 --> 00:21:58.354 Yes, you do. We'll have 00:21:58.366 --> 00:22:00.971 to vote on each one separately. However, 00:22:00.996 --> 00:22:02.698 This first 00:22:02.710 --> 00:22:04.465 extension has to do with a disconnections 00:22:04.490 --> 00:22:08.716 investigation. I'm asking for the extension to be 00:22:08.728 --> 00:22:13.135 extended to next July 2020. A decision was actually 00:22:13.147 --> 00:22:17.634 issued in this proceeding in September which adopted 00:22:17.646 --> 00:22:21.720 a settlement that requires PG&E to provide $100 00:22:21.745 --> 00:22:25.949 bill credit to 6371 customer accounts impacted by 00:22:25.961 --> 00:22:30.347 PGE's violation of its Electric Tariff Rule 8A2. It 00:22:30.359 --> 00:22:35.076 also requires PG&E to contribute $637,100 to the Relief 00:22:35.088 --> 00:22:39.226 for Energy Assistance Through Community Help, or 00:22:39.238 --> 00:22:43.593 the REACH program. PG&E must seek approval from the 00:22:43.605 --> 00:22:48.056 bankruptcy court before making any of these payments 00:22:48.068 --> 00:22:52.261 agreed upon in the decision. In order for this to 00:22:52.273 --> 00:22:56.730 happen, I'm asking for an extension until July 2020. 00:22:56.755 --> 00:23:00.913 Thank you. Are there any comments from the other 00:23:00.925 --> 00:23:05.578 Commissioners? Okay, seeing none. Will the agenda clerk please call the roll? 00:23:05.603 --> 00:23:09.406 For Item 52. Commissioner Shiroma? Aye. Commissioner Guzman Aceves? 00:23:09.431 --> 00:23:12.676 Aye. Commissioner Randolph? Aye. 00:23:12.700 --> 00:23:15.147 Commissioner Rechtschaffen? Yes. 00:23:15.173 --> 00:23:16.983 President Batjer? Aye. 00:23:17.008 --> 00:23:21.654 Thank you. It's unanimous vote. Okay, 00:23:21.666 --> 00:23:25.923 the next item is item 53. Commissioner Guzman Aceves. 00:23:25.948 --> 00:23:29.261 This is a proceeding 00:23:29.273 --> 00:23:32.206 dealing with the Albert Hill System Project, 00:23:32.218 --> 00:23:35.341 a transmission project that Southern California 00:23:35.353 --> 00:23:38.488 Edison has proposed. And we are waiting to hear 00:23:38.500 --> 00:23:41.489 from Southern California Edison to supplement 00:23:41.501 --> 00:23:44.307 the record with additional analysis of the 00:23:44.319 --> 00:23:47.706 alternatives that may serve the needs of the Valley 00:23:47.718 --> 00:23:50.791 South System. SCE, as I mentioned, has not yet 00:23:50.803 --> 00:23:54.043 provided this supplement. And so we are extending 00:23:54.055 --> 00:23:56.917 their timeline until December of this year, 00:23:56.929 --> 00:24:00.241 December 31st of this year. And so I am asking for 00:24:00.253 --> 00:24:03.577 an extension of 12 months to December of next year 00:24:03.589 --> 00:24:06.963 to allow time for the parties to review and respond 00:24:06.975 --> 00:24:09.775 to SCE's showing after it's submitted, and 00:24:09.787 --> 00:24:12.841 it may likely require evidentiary hearings and 00:24:12.853 --> 00:24:16.050 briefings, so I will request an additional year. 00:24:16.075 --> 00:24:17.760 Okay, Thank you. 00:24:17.785 --> 00:24:21.563 Are there any other comments from the Commission? 00:24:21.575 --> 00:24:24.885 Okay. Seeing none, will the agenda clerk please call the roll. 00:24:24.910 --> 00:24:28.282 For Item 53. Commissioner Shiroma? Aye. Commissioner Guzman Aceves? 00:24:28.307 --> 00:24:31.161 Aye. Commissioner Randolph? Aye. 00:24:31.186 --> 00:24:33.323 Commissioner Rechtschaffen? Aye. 00:24:33.348 --> 00:24:34.926 President Batjer? Aye. 00:24:34.951 --> 00:24:39.035 Okay, thank you. Moving on 00:24:39.047 --> 00:24:43.055 to item number 54. Commissioner Guzman Aceves. 00:24:43.080 --> 00:24:46.602 This item is related 00:24:46.614 --> 00:24:49.939 to the disconnections proceeding. The decision, 00:24:49.951 --> 00:24:53.063 this proposal extends the deadline for phase 00:24:53.075 --> 00:24:56.198 one of this proceeding until July 10th 2020. 00:24:56.210 --> 00:24:59.457 It's been a very active proceeding, as you may 00:24:59.469 --> 00:25:02.451 know, it opened in July of 2018. It is the 00:25:02.463 --> 00:25:05.924 implementation of SB598, by Senator Wessel, which 00:25:05.936 --> 00:25:09.549 directed us to develop rules and policies to reduce 00:25:09.561 --> 00:25:12.668 the disconnection rate by 2024. We split the 00:25:12.680 --> 00:25:16.076 proceeding into a series of phases. Phase one is 00:25:16.088 --> 00:25:19.479 addressing the changes to the rules and programs 00:25:19.491 --> 00:25:23.032 to reduce disconnections for the large IOUs. Phase 00:25:23.044 --> 00:25:26.154 one-a will address the same question for the 00:25:26.166 --> 00:25:29.357 smaller IOUs, and Phase two will address more 00:25:29.369 --> 00:25:32.832 innovative approaches to reducing disconnections. 00:25:32.844 --> 00:25:36.181 The preceding, we did issue an interim decision 00:25:36.193 --> 00:25:39.572 under this proceeding last December, and we have 00:25:39.584 --> 00:25:42.628 in place interim protections for vulnerable 00:25:42.640 --> 00:25:46.164 residential customers. Those remain in place until 00:25:46.176 --> 00:25:49.296 we issue a decision in Phase one. I did also 00:25:49.308 --> 00:25:52.552 want a report that in the monthly reports that 00:25:52.564 --> 00:25:55.819 we are receiving from the IOUs, there has been 00:25:55.831 --> 00:25:59.150 a decrease in the disconnection rates. Numerous 00:25:59.162 --> 00:26:02.355 rulings have been issued in Phase one of this 00:26:02.367 --> 00:26:05.470 proceeding, and six workshops have been held 00:26:05.482 --> 00:26:08.597 across the state to solicit party and public 00:26:08.609 --> 00:26:12.204 feedback. The final ruling for Phase one was issued 00:26:12.216 --> 00:26:15.407 on the 14th of November, and opening comments 00:26:15.419 --> 00:26:18.941 are due December 6. And reply comments soon after. 00:26:18.953 --> 00:26:22.072 So additional time is needed to evaluate the 00:26:22.084 --> 00:26:25.335 comments from this party. And I do hope to get 00:26:25.347 --> 00:26:28.610 a decision out in the early part of next year. 00:26:28.610 --> 00:26:32.364 Thank you. Are there any comments from the Commissioners? 00:26:32.376 --> 00:26:35.370 Okay, seeing none, will the agenda clerk please call the roll? 00:26:35.395 --> 00:26:39.023 For Item 54. Commissioner Shiroma? Aye. Commissioner Guzman Aceves? 00:26:39.048 --> 00:26:42.121 Aye. Commissioner Randolph? Aye. 00:26:42.146 --> 00:26:44.474 Commissioner Rechtschaffen? Yes. 00:26:44.499 --> 00:26:46.200 President Batjer? Aye. 00:26:46.200 --> 00:26:50.429 Moving on. Thank you. Moving on to item 00:26:50.441 --> 00:26:54.470 55. You get one more chance. Commissioner Guzman Aceves. 00:26:54.495 --> 00:26:57.950 Okay, this is extension 00:26:57.962 --> 00:27:01.364 for the San Joaquin Valley proceeding that addresses 00:27:01.376 --> 00:27:04.772 the needs of communities that lack access to natural 00:27:04.784 --> 00:27:07.743 gas. The Commission has already adopted three 00:27:07.755 --> 00:27:10.891 substantive decisions under this proceeding. And 00:27:10.903 --> 00:27:14.179 the pilot projects authorized under Phase two will 00:27:14.191 --> 00:27:17.527 be launching in the first quarter of next year. The 00:27:17.539 --> 00:27:20.693 initial data from the pilot projects will become 00:27:20.705 --> 00:27:24.024 available starting the third quarter of 2021. Phase 00:27:24.036 --> 00:27:27.431 three of this proceeding will use data gathered from 00:27:27.443 --> 00:27:30.705 the 11 pilot projects approved in one of our first 00:27:30.717 --> 00:27:33.926 decisions. And throughout the San Joaquin Valley, 00:27:33.938 --> 00:27:37.580 this event, throughout the entirety of the disadvantaged 00:27:37.592 --> 00:27:40.285 communities that we approved in the first 00:27:40.297 --> 00:27:43.369 decision under this proceeding. Any, so for the 00:27:43.381 --> 00:27:46.721 continued work on this proceeding, I'm asking for a 00:27:46.721 --> 00:27:51.761 statutory extension until December of 2021. 00:27:51.786 --> 00:27:54.627 Okay, thank you. Are 00:27:54.639 --> 00:27:57.562 there any comments from the Commissioners 00:27:57.574 --> 00:28:02.943 on this item? Okay, seeing none, will the agenda quirk, please call the roll? 00:28:02.968 --> 00:28:06.075 For Item 55. Commissioner Shiroma? Aye. Commissioner Guzman Aceves? 00:28:06.100 --> 00:28:08.730 Aye. Commissioner Randolph? Aye. 00:28:08.755 --> 00:28:10.745 Commissioner Rechtschaffen? Aye. 00:28:10.770 --> 00:28:12.221 President Batjer? Aye. 00:28:12.246 --> 00:28:15.010 Okay. Thank you. Moving on to item 00:28:15.010 --> 00:28:16.725 56. Commissioner Randolph. 00:28:16.750 --> 00:28:20.564 Okay. Thank you. This proposed 00:28:20.576 --> 00:28:24.607 decision would extend the statutory deadline in one of the 00:28:24.619 --> 00:28:28.713 Metro Gold Line Foothill Extension Construction Authorities 00:28:28.725 --> 00:28:32.557 applications for authority to construct rail crossings. 00:28:32.569 --> 00:28:36.591 Most of those Metro Gold Line cases were assigned to Judge 00:28:36.603 --> 00:28:40.637 Burcham, who has now retired. And this proceeding has been 00:28:40.649 --> 00:28:44.540 reassigned to Judge Goldberg. And as I have mentioned in 00:28:44.552 --> 00:28:48.524 past statutory extension deadline cases, the Construction 00:28:48.536 --> 00:28:52.412 Authority has created a prioritization list of crossings 00:28:52.424 --> 00:28:56.516 that are more construction ready than others. This crossing 00:28:56.528 --> 00:29:00.409 at College Avenue in the city of Claremont is not on the 00:29:00.421 --> 00:29:04.382 high priority list as created, and so we have accordingly 00:29:04.394 --> 00:29:08.067 designated this as somewhat lower priority ourselves. 00:29:08.079 --> 00:29:11.901 And so we need to extend the statutory deadline to June 00:29:11.913 --> 00:29:15.592 8th 2020 to allow the recently assigned judge time to 00:29:15.604 --> 00:29:19.432 process this case. I ask for your support of this item. 00:29:19.457 --> 00:29:22.250 Okay. Thank you. Are there any comments 00:29:22.250 --> 00:29:25.074 on this item from the Commission? Seeing none, 00:29:25.086 --> 00:29:27.680 will the agenda court please call the roll? 00:29:27.680 --> 00:29:33.024 For item 56. Commissioner Shiroma? Aye. Commissioner Guzman Aceves? 00:29:33.049 --> 00:29:37.900 Aye. Commissioner Randolph? Aye. 00:29:37.925 --> 00:29:39.312 Commissioner Rechtschaffen? 00:29:39.337 --> 00:29:43.073 Well, if Commissioner Guzman Aceves is debating 00:29:43.098 --> 00:29:46.474 about it, maybe I should think about it. I support it. Voting aye. 00:29:46.499 --> 00:29:51.362 President Batjer. Aye. Thank you. 00:29:51.387 --> 00:29:55.883 Okay. Moving on to item 57. Commission Rechtschaffen. 00:29:55.908 --> 00:29:59.610 This is an extension 00:29:59.622 --> 00:30:03.483 order in the Locate and Mark investigation for PG&E. 00:30:03.495 --> 00:30:07.349 This is a big, important case. It's an investigation 00:30:07.361 --> 00:30:11.154 we opened in December of last year to examine their 00:30:11.166 --> 00:30:15.164 extensive violations associated with PG&E's Locate and 00:30:15.176 --> 00:30:19.258 Mark program. It's been proceeding quite expeditiously, 00:30:19.270 --> 00:30:23.200 but as I said, it's a very big and detailed case. The 00:30:23.212 --> 00:30:26.935 Safety and Enforcement division and PG&E reached a 00:30:26.947 --> 00:30:31.079 settlement in October and filed that for approval. Since 00:30:31.091 --> 00:30:35.017 then, we've had a hearing on the settlement, comments 00:30:35.029 --> 00:30:38.803 on the settlement, and replies have been filed last 00:30:38.815 --> 00:30:42.601 month. The judge and the assigned Commission office 00:30:42.613 --> 00:30:46.384 are reviewing those comments. We need a three month 00:30:46.396 --> 00:30:50.252 extension to review the comments, prepare a proposed 00:30:50.264 --> 00:30:54.041 decision, and allow time for comments. So I ask for 00:30:54.053 --> 00:30:58.133 your support for an extension until March of next year. 00:30:58.158 --> 00:31:01.858 Okay, are there any comments from the 00:31:01.870 --> 00:31:06.414 Commissioners? Seeing None, will the agenda clerk please call the roll? 00:31:06.439 --> 00:31:09.179 For Item 57. Commissioner Shiroma? Aye. 00:31:09.204 --> 00:31:11.857 Commissioner Guzman Aceves? Aye. 00:31:11.882 --> 00:31:13.423 Commissioner Randolph? Aye. 00:31:13.448 --> 00:31:15.203 Commissioner Rechtschaffen? Yes. 00:31:15.228 --> 00:31:16.505 President Batjer? Aye. 00:31:16.530 --> 00:31:20.394 Thank you. Moving on to Item 58, and guess 00:31:20.406 --> 00:31:24.467 what you really do have one more item, Commissioner Guzman Aceves. 00:31:24.492 --> 00:31:27.645 This item is dealing 00:31:27.657 --> 00:31:30.449 with the Panamint Valley Limestone complaint 00:31:30.461 --> 00:31:33.248 against the Seerless Domestic Water Company. 00:31:33.260 --> 00:31:36.182 In December 2018, Panamint filed the complaint 00:31:36.194 --> 00:31:39.412 against Seerless for improperly refusing to provide 00:31:39.424 --> 00:31:42.096 them with water for a commercial limestone 00:31:42.108 --> 00:31:45.083 quarry. The extension is needed until July, due 00:31:45.095 --> 00:31:48.208 to the fact that in July, there was an earthquake 00:31:48.220 --> 00:31:51.188 earthquake in Ridgecrest which severely damaged 00:31:51.200 --> 00:31:54.554 Seerless Domestic Water Company's facilities and made 00:31:54.566 --> 00:31:57.540 it difficult for them to retrieve documents and 00:31:57.552 --> 00:32:00.601 records needed in this proceeding. The extension 00:32:00.613 --> 00:32:03.771 will allow time to hold an evidentiary hearing and 00:32:03.783 --> 00:32:06.642 will give the ALJ time to prepare a presiding 00:32:06.654 --> 00:32:09.507 officer's decision and serve the parties. I'm 00:32:09.519 --> 00:32:12.321 asking for the extension until June of 2020. 00:32:12.346 --> 00:32:14.180 Okay, Thank you. Are there 00:32:14.180 --> 00:32:16.659 any questions from the Commission on this item. Ok, 00:32:16.671 --> 00:32:18.970 seeing none, agenda clerk, please call the roll? 00:32:20.558 --> 00:32:22.532 For Item 58. Commissioner Shiroma? Aye. 00:32:22.557 --> 00:32:24.461 Commissioner Guzman Aceves? Aye. 00:32:24.486 --> 00:32:26.170 Commissioner Randolph? Aye. 00:32:26.195 --> 00:32:28.115 Commissioner Rechtschaffen? Yes. 00:32:28.140 --> 00:32:29.539 President Batjer? Aye. 00:32:29.564 --> 00:32:32.741 thank you. Moving on to item 59, Commissioner 00:32:32.741 --> 00:32:34.096 Randolph. 00:32:34.121 --> 00:32:39.029 Okay. This is an order extending statutory deadline 00:32:39.041 --> 00:32:43.578 for the OIR to improve public access to public records. I was recently 00:32:43.590 --> 00:32:48.568 assigned this proceeding last month and look forward to taking the next steps 00:32:48.580 --> 00:32:53.315 to move it forward and close it out in June of 2020. This has been a very 00:32:53.327 --> 00:32:57.855 important quasi legislative proceeding, looking at ways to improve our 00:32:57.867 --> 00:33:02.918 processes regarding public records and creating more transparency, efficiency, 00:33:02.930 --> 00:33:07.911 and consistency in how we do things. In January 2019, this Commission adopted 00:33:07.923 --> 00:33:12.469 Decision 1901028, implementing a Revision 1 to General Order 66D. That 00:33:12.481 --> 00:33:17.255 decision address specific concerns in audit, inspection, investigation and 00:33:17.267 --> 00:33:19.999 enforcement matters and included a process 00:33:20.011 --> 00:33:22.245 where Commission staff can invoke, 00:33:22.257 --> 00:33:27.037 when necessary to expedite regulated entities submission of information to 00:33:27.049 --> 00:33:31.969 the Commission. Next, the proceeding will look at developing guidance on the 00:33:31.981 --> 00:33:36.886 standard elements that parties must demonstrate when they support, when they 00:33:36.898 --> 00:33:41.623 submit documents with a claim of confidentiality. We expect to draft a PD 00:33:41.635 --> 00:33:46.418 for the Commission to vote on in early 2020. So this extends the statutory 00:33:46.430 --> 00:33:51.225 deadline to June 14th 2020 to accomplish that. And I ask for your support, 00:33:51.250 --> 00:33:53.783 Okay. Thank you. Is there 00:33:53.795 --> 00:33:56.340 any comment on this item by the Commissioners? 00:33:56.340 --> 00:33:59.746 Okay. Seeing none, will the agenda clerk please call the roll? 00:33:59.771 --> 00:34:02.076 For Item 59. Commissioner Shiroma? Aye. 00:34:02.101 --> 00:34:04.329 Commissioner Guzman Aceves? Aye. 00:34:04.354 --> 00:34:06.323 Commissioner Randolph? Aye. 00:34:06.348 --> 00:34:08.594 Commissioner Rechtschaffen? Yes. 00:34:08.619 --> 00:34:10.260 President Batjer? Aye. 00:34:10.260 --> 00:34:12.866 Thank you. Item 60 does not 00:34:12.878 --> 00:34:15.659 need to be taken up as it was passed on the consent 00:34:15.659 --> 00:34:19.988 agenda. So we will move on in the agenda now to 00:34:20.000 --> 00:34:23.980 the management reports. There are no reports 00:34:23.980 --> 00:34:27.214 for items 62, which is report and discussion on 00:34:27.226 --> 00:34:30.540 recent consumer protection and safety activities. 00:34:30.540 --> 00:34:33.758 And there is no report on item 63 which is 00:34:33.770 --> 00:34:37.300 management report on administrative activities. 00:34:37.300 --> 00:34:40.529 So we will now move on, then to our 00:34:40.541 --> 00:34:43.839 Commissioners reports. I believe that Commissioner Guzman 00:34:43.839 --> 00:34:48.314 Aceves. You will be present on items 64. I 00:34:48.326 --> 00:34:52.499 think before you present, I believe that 00:34:52.499 --> 00:34:55.003 there is someone that you would wish to have a comment. 00:34:55.028 --> 00:34:56.389 Yes, President Batjer. My understanding is 00:34:56.389 --> 00:34:59.124 is that chairwoman from the Pitt River Tribe 00:34:59.136 --> 00:35:01.700 is here. And I would like to invite her to 00:35:01.700 --> 00:35:08.828 make public comments 00:35:08.840 --> 00:35:14.720 since she was not able to make it in time. 00:35:14.745 --> 00:35:18.693 Please come forward. 00:35:23.719 --> 00:35:26.959 Good afternoon, everybody. 00:35:26.971 --> 00:35:30.078 My name's Agnes Gonzales. And I'm the Pitt 00:35:30.090 --> 00:35:32.901 River tribe, tribal chairwoman. Whoops, 00:35:32.913 --> 00:35:36.243 sorry. The Pitt River Tribe and PG&E has had 00:35:36.255 --> 00:35:38.847 a long history with one another. The 00:35:38.859 --> 00:35:42.113 locations where PG&E control and reap their 00:35:42.125 --> 00:35:45.591 benefits from our locations where our ancestors 00:35:45.603 --> 00:35:48.574 had established societies. The locations 00:35:48.586 --> 00:35:51.611 house village sites, earth lodges, burial 00:35:51.623 --> 00:35:54.876 sites and sacred sites. The preservation and 00:35:54.888 --> 00:35:57.845 protection of these have been and always 00:35:57.857 --> 00:36:00.899 will be important to the tribe. There are 00:36:00.911 --> 00:36:04.228 parallel to the destruction of the Pitt River 00:36:04.240 --> 00:36:07.424 people, and the thirst for land and natural 00:36:07.436 --> 00:36:10.542 resources for the purposes of agricultural 00:36:10.554 --> 00:36:13.526 control of land and most and most recent 00:36:13.538 --> 00:36:16.702 hydroelectric developments. The Pitt Rivers 00:36:16.714 --> 00:36:19.962 were seen to be in the way of progress, so a 00:36:19.974 --> 00:36:23.216 large number of Pitt Rivers perished by mean 00:36:23.228 --> 00:36:26.192 of state-endorsed genocide, removal, and 00:36:26.204 --> 00:36:29.298 forced march to other areas in California. 00:36:29.310 --> 00:36:32.417 The tribe, like many others in California, 00:36:32.429 --> 00:36:35.456 suffered great loss. Some bands up to 90% 00:36:35.468 --> 00:36:38.581 to which we are currently recovering from. 00:36:38.593 --> 00:36:41.902 Some disposable giveaway lands lie within and 00:36:41.914 --> 00:36:44.874 on our ancestral areas. We have to apply 00:36:44.886 --> 00:36:47.623 for our own land, sometimes only being 00:36:47.635 --> 00:36:50.963 offered a coop management opportunity. First 00:36:50.975 --> 00:36:54.071 right of refusal allows tribes to purchase 00:36:54.083 --> 00:36:56.973 back our ancestors properties. The Pitt 00:36:56.985 --> 00:37:00.232 River tribe supports the propose tribal land 00:37:00.244 --> 00:37:03.285 transfer policy. Thank you for your time. 00:37:05.380 --> 00:37:10.190 Thank you. Now moving on further to the presentation 00:37:10.202 --> 00:37:14.694 for items 64. The tribal land transfer. Commissioner Guzman Aceves. 00:37:14.719 --> 00:37:20.309 Thank you, President Batjer. It's a great privilege 00:37:20.321 --> 00:37:25.650 for me to be able to present this item today. And first I want to acknowledge 00:37:25.662 --> 00:37:28.312 that this policy builds on the existing 00:37:28.324 --> 00:37:31.395 statutes and two executive orders. Governor 00:37:31.407 --> 00:37:34.336 Brown's Executive Order B1011 and Governor 00:37:34.348 --> 00:37:36.811 Newsom's executive order N1519 with 00:37:36.823 --> 00:37:42.279 which Christina Snyder, the governor's tribal advisor, mentioned earlier today. 00:37:42.291 --> 00:37:47.760 And in particular, I want to acknowledge the most recent work that Commissioner 00:37:47.772 --> 00:37:50.765 Randolph and Commissioner Rechtschaffen did 00:37:50.777 --> 00:37:53.440 in developing our existing CPUC tribal 00:37:53.452 --> 00:37:56.246 consultation policy, which we adopted in 00:37:56.258 --> 00:37:59.132 April of 2018. In our tribal consultation 00:37:59.144 --> 00:38:02.132 policy, we recognized and gave voice to the 00:38:02.144 --> 00:38:04.872 following Commission goals. Recognition 00:38:04.884 --> 00:38:10.146 and respect for tribal sovereignty, encouragement and facilitation of tribal 00:38:10.158 --> 00:38:15.346 participation in Commission proceedings, meaningful consideration of tribal 00:38:15.358 --> 00:38:18.424 interests and issues within the Commission's 00:38:18.436 --> 00:38:21.104 jurisdiction, and protection of tribal 00:38:21.116 --> 00:38:23.971 cultural resources. As was mentioned this 00:38:23.983 --> 00:38:26.917 June in the governor's executive order, he 00:38:26.929 --> 00:38:29.720 recognized California's history, fraught 00:38:29.732 --> 00:38:32.673 with violence, exploitation, dispossession 00:38:32.685 --> 00:38:38.149 and the attempted destruction of tribal communities. This building sits on land 00:38:38.161 --> 00:38:43.568 that belongs to the Cetlantic tribe of the Olani People. Our Sacramento office 00:38:43.580 --> 00:38:46.023 sits on the lands of the Plains Miwa 00:38:46.035 --> 00:38:49.035 people. And our Los Angeles office belongs 00:38:49.047 --> 00:38:51.563 to the Tonva people. The governor not 00:38:51.575 --> 00:38:54.513 only recognized this history but formally 00:38:54.525 --> 00:38:57.312 apologized and established the Truth and 00:38:57.324 --> 00:39:00.464 Healing Council. The governor's order directs 00:39:00.476 --> 00:39:05.880 us to tell the truth about our history and to strive to heal from it. And that 00:39:05.892 --> 00:39:08.473 is the essence of this historic tribal 00:39:08.485 --> 00:39:11.487 land policy. I want to thank Dr. Beth Rose 00:39:11.499 --> 00:39:14.358 Middleton, the chair of the Department of 00:39:14.370 --> 00:39:17.242 Native American Studies at the University 00:39:17.254 --> 00:39:19.905 of California Davis, for condensing the 00:39:19.917 --> 00:39:22.922 specific history that California's energy, 00:39:22.934 --> 00:39:25.865 energy utilities, most notably the history 00:39:25.877 --> 00:39:28.204 of the Western Power Company, the 00:39:28.216 --> 00:39:33.741 predecessor of PG&E, and the century of taking of lands from California natives, 00:39:33.753 --> 00:39:36.817 native peoples. As recently as 1956. Through 00:39:36.829 --> 00:39:39.289 the adoption of today's tribal land 00:39:39.301 --> 00:39:42.157 policy, we recognize the important tribal 00:39:42.169 --> 00:39:45.105 interest in returning the stolen lands and 00:39:45.117 --> 00:39:48.047 giving a voice to meaningful consideration 00:39:48.059 --> 00:39:50.591 and prioritization of this important 00:39:50.603 --> 00:39:55.993 tribal interest. The key provision of this policy is that when a utility tries 00:39:56.005 --> 00:40:01.545 to dispose of any interest in land that it owns, this policy states a preference 00:40:01.557 --> 00:40:07.021 that the land go to the native tribe to which the land belongs. Therefore, when 00:40:07.033 --> 00:40:09.897 proposed transfer comes before us for our 00:40:09.909 --> 00:40:12.716 approval under Section 851 of the Public 00:40:12.728 --> 00:40:15.578 Utilities Code, this policy establishes a 00:40:15.590 --> 00:40:18.316 rebuttable presumption that it transfer 00:40:18.328 --> 00:40:23.655 to an interested tribe is in the public interest. I know there have been some 00:40:23.667 --> 00:40:26.521 recent questions about the public process 00:40:26.533 --> 00:40:29.262 moving forward, and I want to reiterate 00:40:29.274 --> 00:40:32.271 what is in the policy, which is to continue 00:40:32.283 --> 00:40:35.018 to work with the tribes, utilities, and 00:40:35.030 --> 00:40:37.540 other stakeholders, and the public at 00:40:37.552 --> 00:40:40.485 large, to develop the guidelines to fully 00:40:40.497 --> 00:40:43.081 implement this policy. And speaking of 00:40:43.093 --> 00:40:46.168 public process, I want to thank some of the 00:40:46.180 --> 00:40:49.172 key stakeholders and individuals who helped 00:40:49.184 --> 00:40:51.710 produce the policy before us. First, 00:40:51.722 --> 00:40:56.989 I want to thank the tribal nations that hosted the public workshops for this 00:40:57.001 --> 00:41:02.523 policy. The Blue Lake Rancheria in Blue Lake, the Tawalamimiwak into Tuwalme and 00:41:02.535 --> 00:41:08.137 the Pechanga Band of Louis Sanyo Indians in Temecula. I'd like to thank Christina 00:41:08.149 --> 00:41:11.004 Snyder, the governor's travel advisor and 00:41:11.016 --> 00:41:13.951 executive secretary of the Native American 00:41:13.963 --> 00:41:16.208 Heritage Commission, who provided 00:41:16.220 --> 00:41:19.297 invaluable input throughout the process and 00:41:19.309 --> 00:41:22.162 also provided additional venues for us to 00:41:22.174 --> 00:41:25.039 discuss the policy. I want to take, thank 00:41:25.051 --> 00:41:27.910 the utilities, and in particular, PGE for 00:41:27.922 --> 00:41:30.588 their thoughtful and thorough comments 00:41:30.600 --> 00:41:33.524 that greatly enhanced the policy. Internal 00:41:33.536 --> 00:41:36.062 to the Commission, we had tremendous 00:41:36.074 --> 00:41:39.005 help, including a few folks who have since 00:41:39.017 --> 00:41:41.480 left us. One crucial voice has been 00:41:41.492 --> 00:41:44.275 former ALJ Darcy Hauk, who is now at the 00:41:44.287 --> 00:41:47.150 California Energy Commission, and she did 00:41:47.162 --> 00:41:52.490 a huge amount of work putting together this policy and provided the necessary 00:41:52.502 --> 00:41:55.015 trusted environment for many of these 00:41:55.027 --> 00:41:58.303 discussions. I want to acknowledge a few other 00:41:58.315 --> 00:42:03.854 judges who helped. ALJ Kolbert, Fortune and Mackenzie. I want to thank Lon Mayer 00:42:03.866 --> 00:42:06.514 from the Energy Division, who is now at 00:42:06.526 --> 00:42:09.458 the Department of Water Resources for his 00:42:09.470 --> 00:42:12.055 outstanding outreach and input that he 00:42:12.067 --> 00:42:15.143 provided. I'd like to thank Stephanie Gree, 00:42:15.155 --> 00:42:18.011 our tribal liaison. Diedre Cyprian in the 00:42:18.023 --> 00:42:20.754 Executive director's office. Our public 00:42:20.766 --> 00:42:26.034 advisor Alison Brown. And in particular, Hector Garcia, who coordinated much 00:42:26.046 --> 00:42:31.432 of the preparation and logistics for the workshops. And of course, I'd like to 00:42:31.444 --> 00:42:34.028 thank my fellow Commissioner Genevieve 00:42:34.040 --> 00:42:36.978 Shiroma and her advisers, Levantus Fi and 00:42:36.990 --> 00:42:40.118 Justin Reiner, and my legal adviser, Jonathan 00:42:40.130 --> 00:42:42.997 Colts, for all their work and engagement. 00:42:43.009 --> 00:42:48.345 And most importantly, I'd like to think all of the tribal representatives who 00:42:48.357 --> 00:42:51.210 commented on this policy, either formally 00:42:51.222 --> 00:42:54.019 or informally, and as the governor said, 00:42:54.031 --> 00:42:59.295 even though we can never fully repay the injustice, we do, however, have the 00:42:59.307 --> 00:43:01.548 chance today to do more than just 00:43:01.560 --> 00:43:04.633 acknowledge these words. We can take action 00:43:04.645 --> 00:43:07.302 toward building a new relationship with 00:43:07.314 --> 00:43:10.394 California's tribal communities. Thank you. 00:43:10.419 --> 00:43:12.339 And an especially 00:43:12.339 --> 00:43:15.239 strong thank you to you, Commissioner 00:43:15.251 --> 00:43:17.460 Guzman Aceves, for all of your hard work and 00:43:17.460 --> 00:43:20.082 devotion to the policy. Thank you very much. 00:43:20.094 --> 00:43:22.670 Would any of the other Commissioners like to 00:43:22.670 --> 00:43:26.224 comment on this item? Yes, Commissioner Shiroma? 00:43:26.249 --> 00:43:29.150 President Batjer. and thank you, Commissioner 00:43:29.150 --> 00:43:34.739 Guzman Aceves for your leadership on 00:43:34.751 --> 00:43:40.168 the, not only the consultation policy, but also now on the 00:43:40.180 --> 00:43:45.591 tribal land transfer policy. I'm, of course, in support of 00:43:45.603 --> 00:43:50.750 it and I appreciate the efforts made to provide for the 00:43:50.762 --> 00:43:56.354 consultation meetings which I was able to attend one, and it 00:43:56.366 --> 00:44:01.877 was well attended by many other tribes within the San Diego 00:44:01.889 --> 00:44:07.671 Riverside area. I think this is an important step as Christina 00:44:07.683 --> 00:44:13.477 Snyder indicated, the governor's tribal advisor. Thank you for 00:44:13.489 --> 00:44:18.620 attending today. That this, these are important, almost 00:44:18.632 --> 00:44:24.878 incremental, steps when looked at in the landscape of what happened 00:44:24.890 --> 00:44:29.934 at the end of the 1800s into the 1900s of the horrific 00:44:29.946 --> 00:44:35.647 genocide and treatment of tribal people and tribal lands, and 00:44:35.659 --> 00:44:41.436 hopefully, this provides a mitigation of those horrific times. 00:44:41.448 --> 00:44:46.777 I think that the policy provides a good framework. I want 00:44:46.789 --> 00:44:52.389 to thank all of the parties. I also want to thank Chairwoman 00:44:52.401 --> 00:44:57.828 Gonzalez for being here today. And, of course, Art Bagget, 00:44:57.853 --> 00:45:01.495 our appointee to the Stewardship Council and 00:45:01.507 --> 00:45:05.079 former Administrative Law Judge Darcy Hoke, 00:45:05.091 --> 00:45:08.738 who Congratulations on being general counsel 00:45:08.750 --> 00:45:12.410 now of the California Energy Commission. Our 00:45:12.435 --> 00:45:14.448 sister, if not rival agency. 00:45:14.473 --> 00:45:16.173 Not rival. No, no. 00:45:16.198 --> 00:45:18.990 We work in concert. We we actually 00:45:19.002 --> 00:45:21.806 work in concert. It's good to have you there, so thank 00:45:21.818 --> 00:45:24.718 you very much. I know there's more work to be done. This 00:45:24.730 --> 00:45:27.387 is an important, important step to take. Thank you. 00:45:27.413 --> 00:45:29.030 Thank you, Commissioner Shiroma. 00:45:29.030 --> 00:45:34.125 Are there other comments? Yes, Commissioner Rechtschaffen? 00:45:34.150 --> 00:45:38.233 Thank you. Thank you very 00:45:38.245 --> 00:45:42.487 much. Thank you, Commissioner Guzman Aceves for your, all 00:45:42.499 --> 00:45:47.027 your work on this, and for your very, very powerful statement 00:45:47.039 --> 00:45:51.067 just now. And thank you, Christina Snyder for all your 00:45:51.079 --> 00:45:55.165 support on this and the other tribal efforts we've been 00:45:55.177 --> 00:45:59.714 working on. It makes a huge difference. And I want especially 00:45:59.726 --> 00:46:04.111 thank former AL J Halk for an incredible amount of work and 00:46:04.123 --> 00:46:08.154 expertise on this. We miss you already, but we're glad 00:46:08.166 --> 00:46:12.763 that you're in your new position. This land disposition policy 00:46:12.775 --> 00:46:16.945 is one of the many steps that the state needs to take to 00:46:16.957 --> 00:46:21.487 remedy the grievous historic injustices that Governor Newsome 00:46:21.499 --> 00:46:25.529 highlighted in his executive order. And it is overdue. 00:46:25.541 --> 00:46:29.555 I won't repeat the provision that Commissioners Guzman 00:46:29.567 --> 00:46:33.959 Aceves mentioned, but our hope and expectation is that as a 00:46:33.971 --> 00:46:38.285 result of this policy, some important lands that utilities 00:46:38.297 --> 00:46:42.402 now own and do not need and that hold special cultural, 00:46:42.414 --> 00:46:46.713 historic and other significance to tribes will be restored 00:46:46.725 --> 00:46:50.670 to the tribes, their rightful owner. And as Christina 00:46:50.682 --> 00:46:55.133 Snyder also mentioned, hopefully this could be a, this could 00:46:55.145 --> 00:46:59.389 be a a template for other state agencies. That would be a 00:46:59.401 --> 00:47:03.630 terrific development. I do have one technical question or 00:47:03.642 --> 00:47:07.882 clarification, Commissioner. My understanding is that the 00:47:07.894 --> 00:47:12.275 intent of this is to subject real property of the utilities 00:47:12.287 --> 00:47:16.241 to transfer, the disposition policy, not equipment or 00:47:16.253 --> 00:47:20.481 intellectual property. And if that's the case, I think we 00:47:20.493 --> 00:47:24.878 need to slightly amend Footnote three, which says that real 00:47:24.890 --> 00:47:29.416 property subject to this policy is defined as, quote, any IOU 00:47:29.428 --> 00:47:33.893 property is disposition is subject to approval in accordance 00:47:33.905 --> 00:47:38.135 with the PU Code 854 to say that real property subject to 00:47:38.147 --> 00:47:42.463 this policy is defined as any IOU real property subject to 00:47:42.475 --> 00:47:46.784 851, so that it doesn't apply to equipment or intellectual 00:47:46.796 --> 00:47:50.898 property. I trust that that's the intent of the policy. 00:47:50.923 --> 00:47:52.880 Yes, I think that would be 00:47:52.880 --> 00:47:55.766 considered a cleanup amendment. 00:47:55.791 --> 00:48:00.171 Okay. Thank you. That's that's it for me. 00:48:00.195 --> 00:48:01.630 Commissioner Randolph? 00:48:01.630 --> 00:48:06.385 Yeah. Thank you, Commissioner 00:48:06.397 --> 00:48:11.251 Guzman Aceves for spearheading this policy. This policy 00:48:11.263 --> 00:48:16.198 acknowledges that each 851 application is different. And 00:48:16.210 --> 00:48:20.896 there may be issues and challenges with each one, but 00:48:20.908 --> 00:48:25.666 it is a clear, articulated, and now approved policy of 00:48:25.678 --> 00:48:30.449 this Commission that this Commission wants to see land 00:48:30.461 --> 00:48:35.051 returned to indigenous peoples where possible. And I 00:48:35.063 --> 00:48:39.839 look forward to continuing to work with you on sort of 00:48:39.851 --> 00:48:44.424 these implementation details and the guidelines that 00:48:44.436 --> 00:48:49.107 have been discussed. I really appreciate the level of 00:48:49.119 --> 00:48:54.131 outreach that you and Commissioner Shiroma and others did 00:48:54.143 --> 00:48:58.820 in terms of working with stakeholders and in terms of 00:48:58.832 --> 00:49:04.274 holding consultations on this policy. And I am very supportive 00:49:04.286 --> 00:49:09.221 of the policy. I agree with Commissioner Rechtschaffen's 00:49:09.233 --> 00:49:13.727 clarifying question. So I think that's an excellent 00:49:13.739 --> 00:49:18.333 edit. And I will certainly be supporting the policy. 00:49:18.358 --> 00:49:26.439 Can I just clarify that the edit is to insert the word real before 00:49:26.451 --> 00:49:34.441 the IOU property. Footnote three on page one? Just the insertion of one word? 00:49:34.466 --> 00:49:35.334 That's correct. 00:49:35.359 --> 00:49:36.317 Okay. Thank you. 00:49:36.342 --> 00:49:43.990 Any other comments from the Commission? Okay. 00:49:43.990 --> 00:49:47.006 Thank you. Can the clerk, please call the roll 00:49:47.018 --> 00:49:49.789 on item number 64, the tribal land transfer 00:49:49.789 --> 00:49:51.429 policy. 00:49:51.454 --> 00:49:53.459 For Item 64. Commissioner Shiroma? Aye. 00:49:53.484 --> 00:49:55.419 Commissioner Guzman Aceves? Aye. 00:49:55.444 --> 00:49:57.156 Commissioner Randolph? Aye. 00:49:57.181 --> 00:49:59.132 Commissioner Rechtschaffen? Yes. 00:49:59.157 --> 00:50:00.579 President Batjer? Aye. 00:50:00.604 --> 00:50:09.453 Thank you. The item has passed unanimously. 00:50:12.262 --> 00:50:14.306 Moving on. Who would like to make a 00:50:14.332 --> 00:50:17.419 Commissioner's report? 00:50:17.444 --> 00:50:21.067 Yes, Commissioner Shiroma? 00:50:21.092 --> 00:50:24.607 Thank you. President 00:50:24.619 --> 00:50:28.460 Batjer. Yes, I have several things to report. On 00:50:28.472 --> 00:50:32.386 November 22nd, Commissioner Guzman Aceves and our 00:50:32.398 --> 00:50:36.167 staff attended the launch of the iFoster Phones 00:50:36.179 --> 00:50:40.089 for Foster Youth Program. This is a pilot program 00:50:40.101 --> 00:50:43.553 that came through the Commission's Lifeline 00:50:43.565 --> 00:50:47.168 Pilot Program effort, and Commissioner Guzman 00:50:47.180 --> 00:50:51.108 Aceves carried that one across the finish line. I 00:50:51.120 --> 00:50:54.873 got to then take the baton. Okay, we shared. We 00:50:54.885 --> 00:50:58.570 shared it. And we celebrated recently in South 00:50:58.582 --> 00:51:02.340 Gate, where iFoster and Boost Mobile, which had 00:51:02.352 --> 00:51:05.965 developed the partnership, provided a kickoff 00:51:05.977 --> 00:51:09.968 effort. And at this kickoff effort, which is going 00:51:09.980 --> 00:51:13.905 to be for a goal of providing the 33,000 eligible 00:51:13.917 --> 00:51:17.364 foster youth and transitioning age youth to 00:51:17.376 --> 00:51:21.149 have phone service and a smartphone, this is so 00:51:21.161 --> 00:51:24.834 essential for the success of any of us. And if 00:51:24.846 --> 00:51:28.609 folks are familiar with the foster youth in our 00:51:28.621 --> 00:51:32.614 state, there are many, many challenges. This event 00:51:32.626 --> 00:51:36.239 was so wonderful insofar as the transitioning 00:51:36.251 --> 00:51:40.241 age youth through the AmeriCorps also provided for 00:51:40.253 --> 00:51:43.862 various mentorship tables as far as the youth 00:51:43.874 --> 00:51:47.635 who are coming in, the transitioning age youth, 00:51:47.647 --> 00:51:51.262 coming in to receive their free phones and to 00:51:51.274 --> 00:51:54.949 start up their service, to walk through things 00:51:54.961 --> 00:51:58.804 like financial literacy, emotional care, looking 00:51:58.816 --> 00:52:02.575 at how do you balance a budget, in terms of, if 00:52:02.587 --> 00:52:06.358 you have only so much resources, and the, these 00:52:06.370 --> 00:52:09.812 youth who themselves are foster youth, they 00:52:09.824 --> 00:52:13.827 developed this entire program for that day. It was 00:52:13.839 --> 00:52:17.758 well attended, including Assembly Speaker Anthony 00:52:17.770 --> 00:52:21.466 Randon, and representatives of Mayor Garcetti, 00:52:21.478 --> 00:52:25.464 the County, the Education Department and it really 00:52:25.476 --> 00:52:29.082 was a wonderful kickoff. I do wanna thank the 00:52:29.094 --> 00:52:33.087 Communications Division staff who were there Shari 00:52:33.099 --> 00:52:36.554 Worster and Caleb Jones. It was a very good 00:52:36.566 --> 00:52:40.084 start to get that 33,000 youth signed up for 00:52:40.096 --> 00:52:43.784 the program. Then, speaking of Lifeline, we do 00:52:43.796 --> 00:52:47.477 have a committee meeting coming up. It's going 00:52:47.489 --> 00:52:51.340 to be on December 9th in Vice Eliot, at the Vice 00:52:51.352 --> 00:52:55.104 Eliot Convention Center. The Advisory Committee 00:52:55.116 --> 00:52:58.881 meets once a quarter. The Advisory Committee is 00:52:58.893 --> 00:53:02.809 charged with providing advice and recommendations 00:53:02.821 --> 00:53:06.513 to the Commission on the marketing programs to 00:53:06.525 --> 00:53:10.124 achieve the overall Lifeline's program goals, 00:53:10.136 --> 00:53:14.139 providing that basics service. We heard little bit 00:53:14.151 --> 00:53:18.069 today for one of our speakers about how essential 00:53:18.081 --> 00:53:21.541 it is to have, whether it's a wireline or a 00:53:21.553 --> 00:53:25.462 wireless or a voiceover Internet, it is essential 00:53:25.474 --> 00:53:29.394 and it is especially essential for our low income 00:53:29.406 --> 00:53:32.929 qualifying households. And then finally, the 00:53:32.941 --> 00:53:36.711 next day on December 10th, we will have our Low 00:53:36.723 --> 00:53:40.163 Income Oversight Board quarterly meeting in 00:53:40.175 --> 00:53:44.178 Hanford, which is just west of Vice Eliot. And the 00:53:44.190 --> 00:53:47.793 details of that meeting could be found on our 00:53:47.805 --> 00:53:51.893 website and laob.cpuc.ca.gov and I encourage anyone 00:53:51.905 --> 00:53:55.658 who's interested in the Commission's low income 00:53:55.670 --> 00:53:59.514 programs, we will be hearing from the IOUs, from 00:53:59.526 --> 00:54:02.892 PG&E, San Diego Gas and Electric, Southern 00:54:02.904 --> 00:54:06.754 California helping Edison and SoCal gas on their 00:54:06.766 --> 00:54:10.365 progress in this next phase of the low income 00:54:10.377 --> 00:54:14.460 discount programs and the reauthorization programs. 00:54:14.472 --> 00:54:18.156 We'll also be hearing about the progress being 00:54:18.168 --> 00:54:21.942 made by the water utilities as well. Thank you. 00:54:21.967 --> 00:54:25.062 Thank you, Commissioner Shiroma. Are there any 00:54:25.074 --> 00:54:28.228 other comments from any of the Commissioners? Commissioner Randolph? 00:54:28.253 --> 00:54:31.849 I'll just mention briefly 00:54:31.861 --> 00:54:35.752 that, tomorrow, we will be hosting a workshop on, with 00:54:35.764 --> 00:54:39.153 the Commissioner Rechtschaffen, on the rules of 00:54:39.165 --> 00:54:42.920 practice and procedure. And we'll be starting at 930 00:54:42.932 --> 00:54:46.513 in the courtroom. And there will be an opportunity 00:54:46.525 --> 00:54:50.118 for stakeholders and interested parties to discuss 00:54:50.130 --> 00:54:54.000 possible changes to our internal rules of practice and 00:54:54.012 --> 00:54:57.611 procedure. And we hope you will attend. Thank you. 00:54:57.636 --> 00:55:02.193 Great. Thank you. Look forward to it. Any other 00:55:02.205 --> 00:55:07.244 comments? I have a quick comment or two. On November 20th, the CPUC held a 00:55:07.256 --> 00:55:12.357 prehearing conference on the emergency preparedness proceeding. The hearing 00:55:12.369 --> 00:55:17.280 focused on responsiveness of the communications service providers during 00:55:17.292 --> 00:55:21.515 the latest wildfires and public safety power shut offs to keep 00:55:21.527 --> 00:55:24.406 telecommunications services on. Compliance 00:55:24.418 --> 00:55:26.973 to D1908025 and engagement and timely 00:55:26.985 --> 00:55:32.021 responsiveness to the requests of the Office of Emergency Services and the 00:55:32.033 --> 00:55:34.108 Department of Forestry and Fire 00:55:34.120 --> 00:55:37.015 Protection. The information obtained will 00:55:37.027 --> 00:55:41.854 be used to inform the scoping memo for Phase two of the proceeding. And 00:55:41.866 --> 00:55:46.772 finally, I would like to thank my interim advisor, Elizabeth Podolinsky, 00:55:46.784 --> 00:55:51.684 who has accepted a job here at the PUC, I'm glad to say, with the Safety 00:55:51.696 --> 00:55:56.676 Enforcement division. When I came on board, she graciously agreed to stay 00:55:56.688 --> 00:56:01.451 on and help me with the transition and advise and inform me of many of 00:56:01.463 --> 00:56:03.267 the important things in the 00:56:03.279 --> 00:56:06.372 telecommunications and water worlds. I enjoy 00:56:06.384 --> 00:56:11.355 working with you very much, Liz. And I am pleased that we will be able to 00:56:11.367 --> 00:56:16.215 continue working together. So I wish you well, and thank you very much. 00:56:16.240 --> 00:56:22.802 (applause) 00:56:22.827 --> 00:56:28.177 So that finishes on the Commissioner 00:56:28.189 --> 00:56:32.422 reports. Thank you for everyone who has come 00:56:32.434 --> 00:56:37.790 today. The public meeting is now adjourned. Please clear 00:56:37.802 --> 00:56:42.511 the room for the closed session on legal matters.
