WEBVTT 00:00:09.920 --> 00:00:15.837 Are you all set up there? Okay, I think, let me 00:00:15.849 --> 00:00:21.779 just double check here in Sacramento if we're ready. Do we have any 00:00:21.791 --> 00:00:27.801 members of the public? Not at this time. Okay. All right, then, good 00:00:27.813 --> 00:00:33.487 morning and welcome. I'm calling the California Public Utilities 00:00:33.499 --> 00:00:39.681 Commission Business Meeting of November 13, 2019, Public Agenda Number 00:00:39.693 --> 00:00:45.625 3451 to order. It is with great sadness that I call this meeting in 00:00:45.637 --> 00:00:51.651 honor of Edgar Hansen, a very valued friend, colleague and member of 00:00:51.663 --> 00:00:57.689 the Commission's audio-visual team who passed away just last Friday. 00:00:57.701 --> 00:01:03.696 Colleagues and friends have said Edgar was a wonderful, hard working 00:01:03.708 --> 00:01:09.715 and dedicated ITSD team member, and he was a beautiful light here at 00:01:09.727 --> 00:01:15.816 the CPUC. It is just with great sadness. He seemed to me, in my brief 00:01:15.828 --> 00:01:21.667 meetings with Edgar, to be such a wonderful personality and such a 00:01:21.679 --> 00:01:28.025 eager professional. I just want, before we have a few minutes to reflect 00:01:28.037 --> 00:01:33.699 and take a moment of silence, I want to ask all of you to please 00:01:33.711 --> 00:01:39.803 keep Edgar and his family in your hearts. And I'd like to turn now to 00:01:39.815 --> 00:01:45.831 my fellow commissioners for any reflections they would like to make. 00:01:45.856 --> 00:01:52.563 I just wanted to briefly say that I knew Edgar my whole five 00:01:52.575 --> 00:01:59.216 years here at the Commission. And he was just the sweetest person. And he was always 00:01:59.228 --> 00:02:05.785 here setting up our connections with our committee meetings and with our commission 00:02:05.797 --> 00:02:12.131 meetings and with our closed session up in the big conference room. And whenever 00:02:12.143 --> 00:02:18.833 the equipment would not cooperate, he just sort of cheerfully managed everything. And 00:02:18.845 --> 00:02:25.236 he always had a smile on his face, and he was always happy to say hello and chat. 00:02:25.248 --> 00:02:31.710 And and I will, he and Robert were such an amazing team. And I will really, really 00:02:31.722 --> 00:02:38.352 miss Edgar. So I just wanted to make sure that we spent a moment to think about him. 00:02:38.377 --> 00:02:40.739 Absolutely. 00:02:40.739 --> 00:02:45.781 He was a warm, wonderful, constructive, 00:02:45.793 --> 00:02:50.485 always positive person. And I had written down literally exactly 00:02:50.497 --> 00:02:55.364 what Commissioner Randolph said. I never once saw him angry or in a 00:02:55.376 --> 00:03:00.183 bad mood or without a smile on his face. He will be deeply missed. 00:03:00.208 --> 00:03:07.315 I also wanted to add my deepest sympathies. Like 00:03:07.327 --> 00:03:14.642 the other commissioners, Edgar was one of the first people that I met here 00:03:14.654 --> 00:03:21.865 in San Francisco. And I think for the public that has attended our voting 00:03:21.877 --> 00:03:28.905 meetings and workshops, knew Edgar was a familiar face and always nice. 00:03:28.917 --> 00:03:36.004 Always with a ready smile. And he was taken from us suddenly and that is 00:03:36.016 --> 00:03:43.114 just extra, extra tough. I really want to express, especially to Edgar's 00:03:43.126 --> 00:03:50.900 coworkers or people who worked with him most closely day by day, we are holding 00:03:50.912 --> 00:03:58.114 you close to our hearts as well. And we will not forget Edgar. Thank you. 00:03:58.139 --> 00:04:03.310 Well, he was use my ???? 00:04:03.322 --> 00:04:08.316 brother. I just feel really, for his family. I just, 00:04:08.328 --> 00:04:13.882 the the last conversation I had Edgar, he was very excited 00:04:13.894 --> 00:04:18.706 to retire, to be with his, he was bragging at that 00:04:18.718 --> 00:04:24.268 moment about his granddaughter and her a great athleticism 00:04:24.280 --> 00:04:28.806 and wanting to watch her play, I believe it was 00:04:28.818 --> 00:04:33.998 softball, but you all said it very, very correctly. He 00:04:34.010 --> 00:04:39.013 was a very kind heart. And he will be deeply missed. 00:04:39.038 --> 00:04:43.056 Thank you. I now ask for a 00:04:43.068 --> 00:04:46.755 moment of quiet reflection. Please join me. 00:04:59.631 --> 00:05:05.518 Thank you all very much. I do want to remind 00:05:05.530 --> 00:05:11.610 commission employees how very, very important, in times like this, 00:05:11.622 --> 00:05:17.515 it is to seek out counseling and seek out bereavement counseling 00:05:17.527 --> 00:05:23.613 and help. It's extremely, your health, your mental health and your 00:05:23.625 --> 00:05:29.674 heart health, is very important to us. So please avail yourself to 00:05:29.686 --> 00:05:35.565 the counseling that we are providing.Sso thank you very much for 00:05:35.577 --> 00:05:41.903 joining with me in the moment of silence in remembrance. And everyone 00:05:41.915 --> 00:05:47.438 please join Commissioner Randolph in a pledge to allegience. 00:05:47.463 --> 00:05:55.265 Please rise For the Pledge of Allegiance. I 00:05:55.277 --> 00:06:03.658 pledge allegiance to the flag of the United States of America, and to the 00:06:03.670 --> 00:06:11.591 Republic for which it stands, one nation under God, indivisible, with 00:06:11.603 --> 00:06:20.103 liberty and justice for all. Robert, can you play the safety announcement? 00:06:20.128 --> 00:06:24.991 As you are aware, our number one priority is safety. As 00:06:25.003 --> 00:06:29.750 such, we were address certain safety concerns in this venue. In the event 00:06:29.762 --> 00:06:34.695 of an emergency, please calmly proceed toward the exits. We have four exits, 00:06:34.707 --> 00:06:39.396 two in the rear and one on either side of the dais. In the event we need 00:06:39.408 --> 00:06:44.081 to evacuate the building, our assembly point is in the Garden Plaza area 00:06:44.093 --> 00:06:49.164 between the War Memorial Herbs Theater and the War Memorial Opera House on Van 00:06:49.176 --> 00:06:54.112 Ness. When going out the rear exits, head through the courtyard and down the 00:06:54.124 --> 00:06:58.751 front steps, then head south on Van ness by crossing McAllister Street. 00:06:58.763 --> 00:07:03.491 You'll find the Garden Plaza area on your right immediately after walking 00:07:03.503 --> 00:07:08.115 past the Herbs theater. When going out the side exits after heading out 00:07:08.127 --> 00:07:13.118 either exits, you'll find yourself on Golden Gate Avenue. From there, proceed 00:07:13.130 --> 00:07:17.876 east, turn south on Van Ness, and walked towards McAllister Street. After 00:07:17.888 --> 00:07:23.004 crossing McCallister, the Garden Plaza area will be on your right after passing 00:07:23.016 --> 00:07:27.631 the War Memorial Herbs Theater. In the event of an emergency, Executive 00:07:27.643 --> 00:07:32.123 Director Alice Stebbins will call 911, and our public advisor, Alison 00:07:32.135 --> 00:07:36.756 Brown, is certified in CPR and first aid. Thank you for your attention. 00:07:36.781 --> 00:07:41.702 Okay, we now turn to public comment. 00:07:41.714 --> 00:07:46.089 The commission provides three minutes to each speaker. 00:07:46.101 --> 00:07:50.710 There will be a sign held up in front of you over here to 00:07:50.722 --> 00:07:55.103 alert you of one minute remaining. If you have written 00:07:55.115 --> 00:07:59.481 comments, please hand them to Executive Director Alice 00:07:59.493 --> 00:08:04.190 Stebbins. The Commission rules do not allow for parties in 00:08:04.202 --> 00:08:08.814 proceedings to speak about open proceedings. However, the 00:08:08.826 --> 00:08:13.688 public can make comments addressing items on the consent and 00:08:13.700 --> 00:08:18.055 regular agendas and including items not on the agenda. 00:08:18.067 --> 00:08:22.752 Please note that there will not be public comment on items 00:08:22.764 --> 00:08:27.364 on the closed session agenda. With that guidance in mind, 00:08:27.376 --> 00:08:31.908 I welcome today's speakers. Please come up to the podium 00:08:31.920 --> 00:08:36.358 when I call your name, and I'm also gonna call the next 00:08:36.370 --> 00:08:41.138 person in line. And they can take a seat right up front, so 00:08:41.150 --> 00:08:45.991 that they'll be near the podium for public comment to start. 00:08:46.003 --> 00:08:50.300 Our first two commenters are Will Abrams and Tom Dow. 00:08:50.325 --> 00:08:56.896 (no sound), party to a few the different proceedings. 00:08:56.908 --> 00:09:03.680 But I'm here today to speak as an individual resident of Sonoma County. 00:09:03.692 --> 00:09:10.080 And I very much appreciate the recent press releases and statements 00:09:10.092 --> 00:09:16.399 that have come from the Commission. I think I've been particularly 00:09:16.411 --> 00:09:22.609 pleased with the urgency expressed in those documents and through 00:09:22.621 --> 00:09:29.018 those statements. I think all of us are feeling the pain associated 00:09:29.030 --> 00:09:34.951 with recent activity from our utilities, from the power safety 00:09:34.963 --> 00:09:41.461 shutoffs. I did want to speak a little bit about the implications to 00:09:41.473 --> 00:09:48.234 residents. So myself and my family left the initial power shut off that 00:09:48.246 --> 00:09:54.831 happened a few weeks ago, and were trying to plan accordingly, didn't 00:09:54.843 --> 00:10:01.516 know where we would head to. The Kincaid Fire had us evacuate a second 00:10:01.528 --> 00:10:07.648 time with our family, and we were looking for safe places to go. 00:10:07.660 --> 00:10:14.423 I think many folks who are in California are wondering where is safety. 00:10:14.435 --> 00:10:20.364 I think part of what goes through folks' minds as they look at 00:10:20.376 --> 00:10:27.052 these events are the safety implications, obviously, and the financial 00:10:27.064 --> 00:10:33.469 implications. I've had friends come to me who lost substantial sums 00:10:33.481 --> 00:10:40.141 of money due to the power outages. I've had a number of people who ran 00:10:40.153 --> 00:10:46.355 from the flames in the 2017 wildfires and the 2018 wildfires were 00:10:46.367 --> 00:10:52.845 particularly traumatised by this round of wildfires, wondering where 00:10:52.857 --> 00:10:59.347 to go. For myself and my family, we evacuated from the Kincaid fire. 00:10:59.359 --> 00:11:05.739 We saw wildfires along the Richmond area. And then were troubled by 00:11:05.751 --> 00:11:12.050 the fires at the Kirkiness bridge, and we just need to really keep 00:11:12.062 --> 00:11:18.731 the implications of public safety and financial security in mind. Many 00:11:18.743 --> 00:11:24.953 Californians are debating about whether California is still safe. 00:11:24.965 --> 00:11:31.439 Is this a safe place to live? We are on the front lines of attacking 00:11:31.451 --> 00:11:38.218 climate change right here in this room. If we cannot do it in the state 00:11:38.230 --> 00:11:44.804 of California, the most progressive state in the country, in the most 00:11:44.816 --> 00:11:50.931 progressive city, in the state of California and with the people 00:11:50.943 --> 00:11:56.949 in this room, it does not bode well for others in terms of this 00:11:56.961 --> 00:12:03.543 approach. I appreciate the urgency expressed in the communications. I 00:12:03.555 --> 00:12:10.319 ask that the Commission please take meaningful steps to set the playing 00:12:10.331 --> 00:12:16.261 field to set the ground rules for the path forward. Thank you. 00:12:16.260 --> 00:12:21.276 Mr Abrams, can I ask you a question? You 00:12:21.288 --> 00:12:26.316 said this this set of wildfires was particularly traumatizing. Is that 00:12:26.328 --> 00:12:31.704 because it's the third straight year, or because the scale evacuations made 00:12:31.716 --> 00:12:36.750 it difficult for people to find a place to relocate? Or a combination? 00:12:36.750 --> 00:12:41.287 Yeah, all the above. So, you know, after, 00:12:41.299 --> 00:12:45.368 you know, 2017. So I lost my home, we ran from the 00:12:45.380 --> 00:12:49.604 flames, had literally no warning, and then, the next 00:12:49.616 --> 00:12:54.170 year in Santa Rosa, we had to deal with the smoke coming 00:12:54.182 --> 00:12:58.482 from Paradise and the trauma that occurred there, you 00:12:58.494 --> 00:13:02.567 know, sending our kids out to school in facemasks, 00:13:02.579 --> 00:13:07.285 wondering, are they gonna have school today? Is it safe in 00:13:07.297 --> 00:13:11.775 the community for them? And then we regroup as a family 00:13:11.787 --> 00:13:16.165 and say, OK, we made it through this year, and then we 00:13:16.177 --> 00:13:20.568 prepare a plan for where we can go, where are we going 00:13:20.580 --> 00:13:24.885 toe live in the state of California, where it's going 00:13:24.897 --> 00:13:29.293 to be safe? Is it out of the wildlife urban interface? 00:13:29.305 --> 00:13:33.607 Is it away from utility infrastructure that can cause 00:13:33.619 --> 00:13:37.932 fires? And then this year, as we're evacuating, where 00:13:37.944 --> 00:13:42.092 do we go? There's no indication of where it's safe. 00:13:42.104 --> 00:13:46.264 Is it financially secure? Can I build a life for my 00:13:46.276 --> 00:13:50.409 family and provide financial security for my family 00:13:50.421 --> 00:13:54.805 while these things are still going on? These questions 00:13:54.817 --> 00:13:59.036 are being asked by everyone, and the more discussion 00:13:59.048 --> 00:14:03.519 there is without substantive ground rules for how we're 00:14:03.531 --> 00:14:07.508 going to have a path forward. There needs to be a 00:14:07.520 --> 00:14:12.067 comprehensive strategy, and by no means is this the only 00:14:12.079 --> 00:14:16.540 place for that strategy to occur. It's happening in all 00:14:16.552 --> 00:14:20.946 sectors, but this is where the leadership needs to be. 00:14:20.958 --> 00:14:25.253 Part of what's wonderful about regulators is that you 00:14:25.265 --> 00:14:29.651 can cut through the rhetoric, right? And setting rules 00:14:29.663 --> 00:14:33.883 and regulations for how we have a path forward is so 00:14:33.895 --> 00:14:38.208 critical. And that's why I feel that this is where we 00:14:38.220 --> 00:14:42.677 really need to set the standard for how we move forward 00:14:42.689 --> 00:14:46.998 as a state in adjusting climate change and addressing 00:14:47.010 --> 00:14:51.314 the wildfires and all the things that are coming from 00:14:51.326 --> 00:14:55.561 it. So it's it's particularly distressful for folks. 00:14:55.586 --> 00:15:02.497 Thank you. Tony Dow, followed by Anthony Zuniga. 00:15:02.522 --> 00:15:07.833 my name is Tom Dow, and Tony was on Leave It to Beaver. 00:15:07.845 --> 00:15:13.088 But I take it as a compliment. For those of you who will remember 00:15:13.100 --> 00:15:18.019 Leave it to Beaver that is. I'm here, thank you, for the time 00:15:18.031 --> 00:15:23.121 to speak. I'm here to speak regarding an item that's not on the 00:15:23.133 --> 00:15:28.686 agenda, but it will be on the next meeting agenda, which is AA170905. 00:15:28.698 --> 00:15:33.467 In plain English, the port of San Diego's shore power rates 00:15:33.479 --> 00:15:38.799 for cruise lines. I'm with Carnival Corporation, now a consultant, 00:15:38.811 --> 00:15:43.427 after 23 years of employment. Carnival Corp is the parent 00:15:43.439 --> 00:15:48.354 of Holland America, Princes, and Carnival Cruise lines, among 00:15:48.366 --> 00:15:53.690 others, were engaged in a very competitive leisure travel industry 00:15:53.702 --> 00:15:59.259 vacation industry with many choices of where the ships go and whether 00:15:59.271 --> 00:16:04.203 people take a cruise or not. It is a very competitive market. 00:16:04.215 --> 00:16:09.849 The short power requirement to connect ships to grid tight electricity 00:16:09.861 --> 00:16:14.472 is relatively recent. It's not a new phenomenon. In fact, 00:16:14.484 --> 00:16:19.328 my company was involved in developing it years ago, but it's 00:16:19.340 --> 00:16:24.276 successful.Tthe recent administrative law judge's decision or 00:16:24.288 --> 00:16:29.594 recommendation, we appreciate the work that the judge did on this, 00:16:29.606 --> 00:16:34.448 it is a challenging issue. We have a unique load, a big load 00:16:34.460 --> 00:16:39.852 that's only there a few hours a week. But unfortunately, the result 00:16:39.864 --> 00:16:44.711 of this recommendation would be result in about three times, 00:16:44.723 --> 00:16:49.635 300% increase in rates. And what is described as a glide path 00:16:49.647 --> 00:16:54.650 could in fact, be an off-ramp by five years out, an exit ramp. 00:16:54.662 --> 00:16:59.739 We've had a good relationship with the Port of San Diego, along 00:16:59.751 --> 00:17:04.840 with other ports in California for many years. We hope that the 00:17:04.852 --> 00:17:10.081 Commission can consider and work on a solution that will allow us 00:17:10.093 --> 00:17:15.492 to continue that. It seems a little bit like what I'm talking about 00:17:15.504 --> 00:17:20.500 cruise vacations when it's compared to the first two topics is 00:17:20.512 --> 00:17:25.600 somewhat trivial, maybe, but for a lot of people working in San 00:17:25.612 --> 00:17:30.367 Diego and the port itself, it's an important segment of the 00:17:30.379 --> 00:17:35.781 economy. And I appreciate the time that you've taken. We want it to 00:17:35.793 --> 00:17:40.792 be competitive. And this would put San Diego a non-competitive 00:17:40.804 --> 00:17:46.133 situation compared to other California ports. Thank you very much. 00:17:46.158 --> 00:17:50.628 Thank you. Anthony Zuniga. 00:17:50.640 --> 00:17:54.863 followed by Reinette Senum, mayor of Nevada City. 00:17:54.888 --> 00:17:59.464 Good morning, Commissioners. My name is Anthony 00:17:59.476 --> 00:18:03.438 Zuniga. I'm the president of the International Longshore 00:18:03.450 --> 00:18:07.615 and Warehouse Union, Local 29, in San Diego. I'm here today 00:18:07.627 --> 00:18:11.804 regarding Case A170905. I stand here today to support SDG&E 00:18:11.816 --> 00:18:15.978 and the port of San Diego in requesting a competitive shore 00:18:15.990 --> 00:18:20.302 power rate for the cruise terminals. The IOWU represents over 00:18:20.314 --> 00:18:24.482 42,000 members. That's including the dock workers that load 00:18:24.494 --> 00:18:28.604 and unload ships in the US, West Coast, Alaska and Hawaii. 00:18:28.616 --> 00:18:32.916 This includes about the 500 members that I represent the port 00:18:32.928 --> 00:18:37.030 of San Diego and the cruise ship terminals we work. Cruise 00:18:37.042 --> 00:18:41.139 ships are important to our livelihood as each vessel calls 00:18:41.151 --> 00:18:45.329 for about 40 to 70 longshoremen when in port, and these are 00:18:45.341 --> 00:18:49.504 living wage jobs that allow us to provide for our families, 00:18:49.516 --> 00:18:53.691 send our kids to schools and save for retirement. And we do 00:18:53.703 --> 00:18:57.942 not want this to go away. In fact, when cruise ships reached 00:18:57.954 --> 00:19:01.857 a low of 68 in 2014, that represented economic hardship 00:19:01.869 --> 00:19:06.093 for us. But the hard work with the Port of San Diego and the 00:19:06.105 --> 00:19:10.064 cruise lines, the number of cruises will reach about 100 00:19:10.076 --> 00:19:14.028 this year, and we hope to see the number of cruise ships 00:19:14.040 --> 00:19:18.282 rise back to our peak in 2008, which was 255 cruise vessels. 00:19:18.294 --> 00:19:22.452 Controlling costs such as electricity costs, it's important 00:19:22.464 --> 00:19:26.634 to our recovery in San Diego and getting these cruise ships 00:19:26.646 --> 00:19:30.811 back. So for that reason, I'm here to ask the Commission to 00:19:30.823 --> 00:19:35.138 carefully consider your decision on electricity rates for the 00:19:35.150 --> 00:19:39.376 cruise ships calling in San Diego. Each ship, each ship call 00:19:39.388 --> 00:19:43.696 is important to the IOWU regional employment and the regional 00:19:43.708 --> 00:19:47.940 economy and would be a shame at the C PUC sets rates to high 00:19:47.952 --> 00:19:51.987 slowing our upward growth in cruise calls or even leading 00:19:51.999 --> 00:19:56.089 the less cruise calls in San Diego. That wouldn't help any 00:19:56.101 --> 00:20:00.203 of us. That wouldn't help the 500 longshoremen I represent 00:20:00.215 --> 00:20:04.381 in San Diego, the electricity ratepayers or the city of San 00:20:04.393 --> 00:20:08.222 Diego in itself. I thank you for your time, thank you. 00:20:08.247 --> 00:20:16.790 Thank you, Mayor Senum. Followed by Rebecca Lieberman. 00:20:16.815 --> 00:20:20.078 Hello. Thank you so much. I appreciate 00:20:20.090 --> 00:20:23.021 this time to speak to all of you today. My name is 00:20:23.033 --> 00:20:26.303 Reinette Senum. I come from Nevada City, California. The 00:20:26.315 --> 00:20:29.482 place that PG&E was signed into existence. As a matter 00:20:29.494 --> 00:20:32.703 of fact. I'm gonna go through very quickly, so you have 00:20:32.715 --> 00:20:35.936 to listen fast, of a laundry list of the effects of the 00:20:35.948 --> 00:20:39.279 PSPS event on our community in Nevada City, Grass Valley, 00:20:39.291 --> 00:20:42.172 and Nevada County. We had mom and Pops businesses 00:20:42.184 --> 00:20:45.450 closed for days on end, grocery stores, restaurants. Who 00:20:45.462 --> 00:20:48.739 was also impacted were farmers, deliveries, the elderly, 00:20:48.751 --> 00:20:51.735 disabled were unable to make 911 calls. AirBnBs and 00:20:51.747 --> 00:20:55.030 hotels, manufacturers prepping for holidays. Orders were 00:20:55.042 --> 00:20:58.080 also impacted. Tourism, schools, medical facilities. 00:20:58.092 --> 00:21:01.315 Basically we were sent back into the dark ages. We lost 00:21:01.327 --> 00:21:04.371 electricity. Our cell phones could not get code red, 00:21:04.383 --> 00:21:07.842 whatsoever, could not make a call out or text out. For many 00:21:07.854 --> 00:21:11.004 people are landlines were also affected, our Internet, 00:21:11.016 --> 00:21:14.292 and I would like to speak to something called unintended 00:21:14.304 --> 00:21:17.344 consequences. This was such an incredible hit to our 00:21:17.356 --> 00:21:20.524 local economy that you have to understand that we have 00:21:20.536 --> 00:21:23.573 many nonprofits and watershed organizations that are 00:21:23.585 --> 00:21:26.922 actually trying to restore our forests and the unintended 00:21:26.934 --> 00:21:29.920 consequences of this is we're about ready to repeat 00:21:29.932 --> 00:21:33.218 history, and what I mean is the first ever environmental 00:21:33.230 --> 00:21:36.381 regulation in United States came through what's called 00:21:36.393 --> 00:21:39.671 the Sawyer Act, the Sawyer Act of 1876, when we actually 00:21:39.683 --> 00:21:42.782 stopped the hydraulic mining that was sending all the 00:21:42.794 --> 00:21:45.963 deluge of debris from our mountains into the Delta and 00:21:45.975 --> 00:21:49.071 into the farmland and into the San Francisco Bay. The 00:21:49.083 --> 00:21:52.480 reason why it's so imperative that we have a healthy local 00:21:52.492 --> 00:21:55.652 economy is because that local economy actually invests 00:21:55.664 --> 00:21:58.663 in our local watershed and non-profit organizations 00:21:58.675 --> 00:22:01.937 that restore our forests that are ready to burn down. We 00:22:01.949 --> 00:22:05.051 are very similar to Paradise, and if we have the same 00:22:05.063 --> 00:22:08.274 kind of catastrophic fires, that means not only are you 00:22:08.286 --> 00:22:11.451 going to lose our cities or towns, but you're going to 00:22:11.463 --> 00:22:14.958 lose the stewards of those watersheds. Why is that important 00:22:14.970 --> 00:22:17.845 to all of you here down river? Because if we have 00:22:17.857 --> 00:22:21.071 a catastrophic fire and our old toxic mining legacy, we 00:22:21.083 --> 00:22:24.194 are a gold mining town, that means when you have that 00:22:24.206 --> 00:22:27.470 kind of catastrophic fire, you actually scorch the soil. 00:22:27.482 --> 00:22:30.815 And once again you expose the 150 year old mining legacy. 00:22:30.827 --> 00:22:33.924 What's in that toxic mining legacy? Mercury, arsenic, 00:22:33.936 --> 00:22:36.988 other heavy metals. What does that mean for everyone 00:22:37.000 --> 00:22:40.267 downstream? We're talking 25 million and users of water, 00:22:40.279 --> 00:22:43.558 we're talking that this toxic mining legacy, once again, 00:22:43.570 --> 00:22:46.843 comes to the surface, goes washing down into our streams 00:22:46.855 --> 00:22:49.737 in our watersheds, and it affects the breadbasket 00:22:49.749 --> 00:22:52.954 of America. It goes into the Wine country. It goes into 00:22:52.966 --> 00:22:55.953 the rice fields, it goes into the ranchers. And the 00:22:55.965 --> 00:22:58.947 wineries, it goes on and on and on. And this is the 00:22:58.959 --> 00:23:02.297 unintended consequence. So how do we, what do we do about 00:23:02.309 --> 00:23:05.576 this? The best thing, and what we're trying to do, is we 00:23:05.588 --> 00:23:08.808 want to become our own power utility. We want the power 00:23:08.820 --> 00:23:11.920 grid back in the hands of the people. Why? Because we 00:23:11.932 --> 00:23:15.043 are the stewards of the watershed, of the forests. We 00:23:15.055 --> 00:23:18.320 have everything to lose, and we have everything to gain. 00:23:18.332 --> 00:23:21.493 We will take better care of the transmission lines and 00:23:21.505 --> 00:23:24.891 make sure to decentralize the energy production. So that's 00:23:24.903 --> 00:23:28.071 it's the safest possible and is reliable as possible . 00:23:28.083 --> 00:23:31.120 If this continues the happen, we will cease to exist 00:23:31.132 --> 00:23:34.008 as a community, and the CPUC and PG&E and all the 00:23:34.020 --> 00:23:37.409 citizens of California are going to lose the best stewards 00:23:37.421 --> 00:23:40.419 of your watershed. Thank you so much for your time. 00:23:40.444 --> 00:23:45.220 Thank you. Rebecca Lieberman, followed by Jordan Blatchford 00:23:45.220 --> 00:23:48.474 Good morning, President cnd 00:23:48.486 --> 00:23:52.484 commissioners. I'm here to speak regarding Case A170905. My 00:23:52.496 --> 00:23:56.289 name is Rebecca Lieberman, and I'm here on behalf of the 00:23:56.301 --> 00:23:59.839 San Diego Regional Chamber of Commerce, representing 00:23:59.851 --> 00:24:03.641 over 2500 member businesses and around 300,000 jobs. The 00:24:03.653 --> 00:24:07.188 San Diego Regional Chamber of Commerce is pleased to 00:24:07.200 --> 00:24:10.929 support a sustainable electricity rate for cruise power 00:24:10.941 --> 00:24:14.549 use. The chamber is a longtime partner of the Port of 00:24:14.561 --> 00:24:18.350 San Diego in attracting cruise business to San Diego and 00:24:18.362 --> 00:24:22.096 its terminals. The cruise industry is a critical engine 00:24:22.108 --> 00:24:25.635 for commerce and jobs in the area, accounting for an 00:24:25.647 --> 00:24:29.454 annual economic output of over $80 million and 650 jobs. 00:24:29.466 --> 00:24:32.990 Anything that hampers the cruise industry, including 00:24:33.002 --> 00:24:36.605 rising shore power rates, would negatively affect San 00:24:36.617 --> 00:24:40.281 Diego and the region as a whole. The proposed decision 00:24:40.293 --> 00:24:43.969 confirms that if cruise ships were to leave San Diego, 00:24:43.981 --> 00:24:47.765 other SDG&E customers would end up paying more. Although 00:24:47.777 --> 00:24:51.505 it seems counterintuitive, even when a rate discount is 00:24:51.517 --> 00:24:55.307 given to the account, all SDG&E rate payers benefit from 00:24:55.319 --> 00:24:58.854 the retention of the port's electric sales. Further, 00:24:58.866 --> 00:25:02.252 loss of some or all the port's electric sales will 00:25:02.264 --> 00:25:06.129 increase the revenue burden on all SDG&E rate payers. Put 00:25:06.141 --> 00:25:09.466 simply if cruises go away, other rate payers will 00:25:09.478 --> 00:25:13.350 actually pay more, increasing the burden on the region. A 00:25:13.362 --> 00:25:16.947 drop in electricity sales doesn't create winners, but 00:25:16.959 --> 00:25:20.622 only losers. On behalf of the chamber, I offer my full 00:25:20.634 --> 00:25:24.425 support for approval of the E. M. P between the port and 00:25:24.437 --> 00:25:27.973 SDG&E, so that both may continue to operate the best 00:25:27.985 --> 00:25:31.773 interest of their business and the communities that they 00:25:31.785 --> 00:25:35.385 serve. I also have a signed letter from our president 00:25:35.397 --> 00:25:39.325 and former Mayor, Jerry Sanders, reiterating the Chamber's 00:25:39.337 --> 00:25:42.809 support. Thank you for your time and consideration. 00:25:42.834 --> 00:25:48.162 Thank you. Jordan Latchford. Followed by Conrad Ware. 00:25:48.187 --> 00:25:52.854 Good morning Commissioners. I'm here to speak regarding 00:25:52.866 --> 00:25:57.175 case A 170905. My name is Jordan Latchford, and I'm here on behalf of 00:25:57.187 --> 00:26:01.736 the San Diego Regional Economic Development Corporation in support of the 00:26:01.748 --> 00:26:06.187 Port of San Diego and San Diego Gas and Electric in passing their Joint 00:26:06.199 --> 00:26:10.868 Energy Management pla. EDC is focused on building an inclusive economy that 00:26:10.880 --> 00:26:15.439 maximizes regional prosperity enhances global competitiveness. The cruise 00:26:15.451 --> 00:26:19.757 industry plays a key role in San Diego's tourism and local economy. A 00:26:19.769 --> 00:26:24.457 single in-transit call made as one stop during the cruise generates a total 00:26:24.469 --> 00:26:29.006 economic impact to the region of nearly $600,000. Efforts that hamper the 00:26:29.018 --> 00:26:33.691 cruise industry, including rising shore power rates, are detrimental to San 00:26:33.703 --> 00:26:38.431 Diego and the regional economy as a whole. The shore power rate, as proposed 00:26:38.443 --> 00:26:42.690 by the EMP, will protect the economic outputs of the cruise industry 00:26:42.702 --> 00:26:47.243 in San Diego, while protecting the economic and environmental development 00:26:47.255 --> 00:26:51.746 of the community. In alignment with our mission to maximize the region's 00:26:51.758 --> 00:26:56.612 economic prosperity, San Diego Regional EDC will continue to offer its support 00:26:56.624 --> 00:27:00.936 for approval of this plan. Thank you for your time and consideration. 00:27:00.961 --> 00:27:04.276 Thank you, Conrad Ware. Followed by Emil Borde. 00:27:04.301 --> 00:27:07.471 Good morning, Commissioners. On behalf of 00:27:07.483 --> 00:27:10.777 City of San Diego Mayor, Kevin Faulkner, I'm here to speak 00:27:10.789 --> 00:27:14.078 on Case A170905. We're here today to voice support for the 00:27:14.090 --> 00:27:17.110 CPUC implementing a shore line power electricity rate 00:27:17.122 --> 00:27:20.407 that allows cruise lines to remain and grow their business 00:27:20.419 --> 00:27:23.493 in San Diego and helps the city meet our environmental 00:27:23.505 --> 00:27:26.852 goals. In reviewing the proposed decision by Administrative 00:27:26.864 --> 00:27:29.663 Law Judge Lao, it is clear that setting this rate 00:27:29.675 --> 00:27:32.735 is a complicated challenge. I respectfully request the 00:27:32.747 --> 00:27:35.987 CPUC commissioners be conservative in setting a rate that 00:27:35.999 --> 00:27:39.177 does not push cruises out of our region. You heard today 00:27:39.189 --> 00:27:42.210 from our Chamber of Commerce and Economic Development 00:27:42.222 --> 00:27:45.565 Corporation on how important the cruise line industry is to 00:27:45.577 --> 00:27:48.764 the region. As the Port of San Diego and the greater San 00:27:48.776 --> 00:27:52.069 Diego region move forward with plans for the future, we're 00:27:52.081 --> 00:27:55.050 bound by the California Air Resources Board at-berth 00:27:55.062 --> 00:27:58.006 air emissions regulations that require many types of 00:27:58.018 --> 00:28:01.532 commercial vessels, including cruise ships, to use electricity 00:28:01.544 --> 00:28:04.662 while at berth. Even though shore power increases costs 00:28:04.674 --> 00:28:07.468 for the cruise lines, we support this requirement 00:28:07.480 --> 00:28:11.042 because the environmental benefits it brings. So far, San Diego 00:28:11.054 --> 00:28:14.236 has been able to pair economic growth with environmental 00:28:14.248 --> 00:28:17.425 improvements. San Diego is ahead of schedule in reaching 00:28:17.437 --> 00:28:20.234 its goal of cutting 2010 levels of greenhouse gas 00:28:20.246 --> 00:28:23.582 emissions in half by 2035. And our region's economic output 00:28:23.594 --> 00:28:26.552 continues to rise year over year, while GHG emission 00:28:26.564 --> 00:28:29.739 steadily decrease. However, without the CPUC's help with 00:28:29.751 --> 00:28:32.770 ensuring sustainable shore power rates, this progress 00:28:32.782 --> 00:28:35.842 will be difficult to sustain. Please be our partner in 00:28:35.854 --> 00:28:38.926 keeping economic growth and environmental improvements 00:28:38.938 --> 00:28:42.060 moving in lockstep by setting a competitive shore power 00:28:42.072 --> 00:28:45.318 rate for the cruise lines. Thank you for your time today. 00:28:45.343 --> 00:28:51.425 Thank you. Emil Borde. Followed by Deborah Kaplan. 00:28:51.450 --> 00:28:57.336 Good morning, Commissioners. My name is Emil 00:28:57.348 --> 00:29:03.346 Borde. I am wearing the field jacket of Oregon Fire. Oregon 00:29:03.358 --> 00:29:09.750 Fire is a volunteer fire department located east of White Sands 00:29:09.762 --> 00:29:15.466 Missile Range and northeast of the town of Las Cruces. I 00:29:15.478 --> 00:29:21.467 held the rank of lieutenant and trained with wild land fire 00:29:21.479 --> 00:29:27.580 people as well as structure fires. I've been a volunteer for 00:29:27.592 --> 00:29:33.787 15 years. I've retired and returned back to California. There 00:29:33.799 --> 00:29:39.306 was a horrendous fires here in Northern California the 00:29:39.318 --> 00:29:45.605 past three years. You know them all, the Tubbs, the Atlas,Carr 00:29:45.617 --> 00:29:51.217 Fire, Camp Fire, and recently the Kincaid. All of these 00:29:51.229 --> 00:29:57.523 fires are preventable. I say they are preventable. Why? Number 00:29:57.535 --> 00:30:03.240 one, the fuel load. You can't have a fire unless there's 00:30:03.252 --> 00:30:08.942 something to burn. And we have lots of trees and lots of 00:30:08.954 --> 00:30:15.057 brush that have not been properly maintained over the years. 00:30:15.069 --> 00:30:20.865 I used to see fire breaks as I was a youngster, teenager, 00:30:20.877 --> 00:30:26.785 going out along behind Stanford University and other areas 00:30:26.797 --> 00:30:32.678 in California. You don't see 'em now. All At least I don't 00:30:32.690 --> 00:30:38.682 and traveled around. So what to do? I recommend rescind the 00:30:38.694 --> 00:30:44.780 PSPS. It has put tremendous loads on thousands and thousands 00:30:44.792 --> 00:30:50.291 of people. Businesses are closed. Many are thinking of 00:30:50.303 --> 00:30:56.086 closing if it completes, if they cannot have their power. 00:30:56.098 --> 00:31:01.994 So, there is Indian nation in New Mexico that Mascelleros. 00:31:02.006 --> 00:31:08.095 They're near Rio Doso. I would suggest that staff and others 00:31:08.107 --> 00:31:14.309 look into it. Their primary income comes from tourism as well 00:31:14.321 --> 00:31:20.702 as cattle farming. But they also manage a large track of forest 00:31:20.714 --> 00:31:26.608 which they provide lumber. They don't have wild land fires 00:31:26.620 --> 00:31:32.408 there because they do what's needed to be done to prevent 00:31:32.420 --> 00:31:38.220 them. Cut back the underbrush, cut the limbs off, the low 00:31:38.232 --> 00:31:44.217 hanging limbs off the mature trees. And they even use fire, 00:31:44.229 --> 00:31:49.826 when it's appropriate to do backfire so the fires don't 00:31:49.838 --> 00:31:55.929 start. So again, PSPS has not worked. I don't think it will. 00:31:55.941 --> 00:32:01.844 It's just impossible. So I stand for questions. Thank you. 00:32:01.869 --> 00:32:05.300 Thank you. Deborah Kaplan? 00:32:05.324 --> 00:32:37.799 (inaudible speech, inactive microphone) 00:32:58.300 --> 00:33:02.368 --has given the impression 00:33:02.380 --> 00:33:06.007 that notice is all that's required when 00:33:06.019 --> 00:33:10.094 it's probably, it's very important, but only 00:33:10.106 --> 00:33:13.829 a very small aspect of protecting people 00:33:13.841 --> 00:33:18.366 from not, the effects of not having uninterrupted 00:33:18.378 --> 00:33:21.645 power. It's also, I think, tempting 00:33:21.657 --> 00:33:29.200 to focus on the results of PSPS events when in fact, because especially of climate 00:33:29.212 --> 00:33:36.741 change, we're looking at more and more disasters and emergencies that threaten the 00:33:36.753 --> 00:33:44.565 availability of power even without a PSPS event. And people with disabilities are and 00:33:44.577 --> 00:33:52.203 seniors who rely on power are extremely vulnerable, but also people who understand, 00:33:52.215 --> 00:33:56.203 because many of us have been delivering our 00:33:56.215 --> 00:34:00.306 own programs for services for people to live 00:34:00.318 --> 00:34:08.107 independently. We understand what it takes to actually run an effective program. So I 00:34:08.119 --> 00:34:12.098 think we urge you to work, collaborate with 00:34:12.110 --> 00:34:16.282 us. Listen to those of us who understand what 00:34:16.294 --> 00:34:20.542 it takes to really create an effective program 00:34:20.554 --> 00:34:24.451 and look at the issues very, very broadly. 00:34:24.463 --> 00:34:31.906 Possible solutions if they are defined very narrowly and without understanding of 00:34:31.918 --> 00:34:35.983 complexities of living with a disability can 00:34:35.995 --> 00:34:39.710 miss the mark. And a lot of money can be 00:34:39.722 --> 00:34:43.430 spent without an effective solution that 00:34:43.442 --> 00:34:47.706 actually achieves the goal that we've all been 00:34:47.718 --> 00:34:55.062 working for. So we stand ready to work with you, provide you information, please 00:34:55.074 --> 00:34:59.239 understand that narrow scoping creates narrow 00:34:59.251 --> 00:35:03.246 solutions that are not affected. Thank you. 00:35:03.271 --> 00:35:07.512 Thank you very much. That's it for 00:35:07.524 --> 00:35:11.634 the speakers who signed up ahead of time. Is there anyone 00:35:11.646 --> 00:35:15.998 else here in the public in San Francisco who wishes to speak? 00:35:16.010 --> 00:35:19.880 All right. Seeing that. Is there anyone in Sacramento? 00:35:19.880 --> 00:35:21.340 No, Commissioner 00:35:21.352 --> 00:35:23.143 Randolph. There's no one here in Sacramento. 00:35:23.168 --> 00:35:28.360 All right, thank you. The public comment period is 00:35:28.372 --> 00:35:33.371 now closed. We will now take up the consent agenda, which is consists of 00:35:33.383 --> 00:35:38.718 item one, preliminary categorizations and hearing determinations for recently 00:35:38.730 --> 00:35:43.598 filed formal applications. Is there a motion for the consent calendar? 00:35:43.623 --> 00:35:44.708 Second. 00:35:44.709 --> 00:35:50.393 Okay. Clerk, would you please call the roll 00:35:50.418 --> 00:35:55.646 - Commissioner Shiroma. - Aye. - Commissioner Guzman Aceves. 00:35:55.671 --> 00:36:00.740 - Aye. - Commissioner Randolph. - Aye. 00:36:00.765 --> 00:36:04.526 - Commissioner Rechtschaffen. - Yes. 00:36:04.551 --> 00:36:07.270 - President Batjer. - Aye. 00:36:07.270 --> 00:36:11.024 The consent agenda item has passed 00:36:11.036 --> 00:36:14.990 unanimously. We will now take up Item 2, the order instituting 00:36:15.002 --> 00:36:18.603 investigation into the late 2019 Public Safety Power Shut 00:36:18.615 --> 00:36:21.979 Off events. President Batjer will introduce item two. 00:36:22.004 --> 00:36:28.389 Thank you, Commissioner Randolph. Item two is an order 00:36:28.401 --> 00:36:35.054 instituting an investigation to determine whether California's investor-owned 00:36:35.066 --> 00:36:41.543 utilities prioritized safety and complied with the Commission's regulations 00:36:41.555 --> 00:36:48.128 and requirements with respect to their public safety power shut off, or PSPS 00:36:48.140 --> 00:36:54.870 events, in late 2000. As I said at the commission meeting on October 18, 2019, 00:36:54.882 --> 00:37:01.111 these sustained PSPS events cannot be the new normal for California. The 00:37:01.123 --> 00:37:07.688 frequency and scope of the PSPS events of 2019 impacted communities and in a 00:37:07.700 --> 00:37:14.277 profound way. It is imperative that we do more to mitigate wildfire risk and 00:37:14.289 --> 00:37:20.932 reduce the use of PSPS in the future. The Commission opens this investigation 00:37:20.944 --> 00:37:27.769 as a companion to the rulemaking 18-12-005 which examines utility denergization 00:37:27.781 --> 00:37:34.515 of power lines in dangerous conditions. In addition to improving the practices 00:37:34.527 --> 00:37:40.419 of the utilities in their future, we must also hold them accountable 00:37:40.431 --> 00:37:47.248 for their conduct. This investigation will serve as a forum for taking evidence 00:37:47.260 --> 00:37:53.491 to evaluate both the effectiveness and impacts of all phases of the PSPS 00:37:53.503 --> 00:37:59.898 events. In the first phase of this proceeding, the Commission's Safety and 00:37:59.910 --> 00:38:06.318 Enforcement Division, or SED, shall investigate and produce a consultant's 00:38:06.330 --> 00:38:12.795 report that evaluates the utilities actions prior to, during, and after the 00:38:12.807 --> 00:38:18.859 PSPS events in late 2019 and utility compliance with the CPUC existing 00:38:18.871 --> 00:38:25.769 denergization regulations and requirements. The report shall also assess whether 00:38:25.781 --> 00:38:32.179 further changes to existing denergization regulations and requirements are 00:38:32.191 --> 00:38:39.001 necessary to ensure public safety. The consultant shall also review the quality 00:38:39.013 --> 00:38:45.238 of the utilities, internal coordination, situational awareness, external 00:38:45.250 --> 00:38:51.725 communications both from the point of view of the amount and quality of the 00:38:51.737 --> 00:38:58.224 information provided and the effectiveness of the utilities, chosen methods 00:38:58.236 --> 00:39:04.362 of communications, preplanning and execution of these PSPS events. This 00:39:04.374 --> 00:39:11.365 investigation will also serve as a forum for the Commission to consider instances 00:39:11.377 --> 00:39:17.680 when an electric corporations actions related to a PSPS event resulted in 00:39:17.692 --> 00:39:23.750 violations of any statutes or CPUC's rules or regulations. If apparent 00:39:23.762 --> 00:39:30.403 violations are found, the Commission will take action to ensure utilities are 00:39:30.415 --> 00:39:36.812 held accountable. This investigation is important part of the Commission's 00:39:36.824 --> 00:39:43.642 examination of PSPS events and ensuring public safety and safe reliable utility 00:39:43.654 --> 00:39:50.057 service into the future. I ask your support of this proceeding. Thank you. 00:39:50.082 --> 00:39:56.201 All right, do any of the Commissioners have comments? 00:39:56.225 --> 00:40:00.570 Thank you. Thank you. 00:40:00.582 --> 00:40:04.561 Present Batjer and Commissioner Randolph. 00:40:04.573 --> 00:40:12.446 I think this is an important step. This has been get another year of of tumultuous 00:40:12.458 --> 00:40:20.420 wildfire, and layered on top of that, the very, very expansive public safety powers 00:40:20.432 --> 00:40:28.026 that the community's experienced. I very much appreciate in the comments of the 00:40:28.038 --> 00:40:35.902 people who came today to speak with us, and I want to particularly note your Mayor 00:40:35.914 --> 00:40:39.413 Senum of Nada City. Very eloquent in 00:40:39.425 --> 00:40:43.885 describing what happened to your community and 00:40:43.897 --> 00:40:52.147 the fact that, while Nevada City and Grass Valley are in a rural setting, very similar 00:40:52.159 --> 00:40:59.851 to Paradise, that it's not only the effect on the businesses and the people, the 00:40:59.863 --> 00:41:04.210 grocery stores and so forth, it is the higher 00:41:04.222 --> 00:41:08.390 environment and highlighting the importance 00:41:08.402 --> 00:41:16.182 of the rural communities, which may have less customers but have a very important 00:41:16.194 --> 00:41:24.158 role to play in our overall environment of California and the safety of California. 00:41:24.170 --> 00:41:31.861 All of these systems are interrelated. As we look at our steps to the future, as 00:41:31.873 --> 00:41:39.833 far as what does it mean for California as a whole, not simply a matter of of rural 00:41:39.845 --> 00:41:47.913 versus urban, forested areas or not? All of this has an interplay. I think that it's 00:41:47.925 --> 00:41:55.416 very important, as President Batjer has outlined, that we continue to take the 00:41:55.428 --> 00:41:59.881 experience garnered, determine were our orders 00:41:59.893 --> 00:42:03.787 complied with in the first place that we 00:42:03.799 --> 00:42:11.086 updated last spring? And then are there experiences to be guarded for making 00:42:11.098 --> 00:42:15.447 improvements to our decisions and our orders? 00:42:15.459 --> 00:42:19.345 I think that overall, nothing is done in 00:42:19.357 --> 00:42:23.419 isolation, that last spring we set in play 00:42:23.431 --> 00:42:27.693 updated wildfire mitigation plans, requiring 00:42:27.705 --> 00:42:35.674 additional hardening, requiring additional vegetation management. And then also the 00:42:35.686 --> 00:42:39.651 denergization decision, refered to as the 00:42:39.663 --> 00:42:43.925 public safety power shut off, a last resort. 00:42:43.937 --> 00:42:51.523 All of these things are meant to have a panoply of tools towards protecting our 00:42:51.535 --> 00:42:59.590 communities and protecting customers and reducing risk. And this is our quest. And I 00:42:59.602 --> 00:43:04.145 think this order to investigate is an important 00:43:04.157 --> 00:43:07.669 step for further refining. And as we 00:43:07.681 --> 00:43:15.728 prepare for next year's wildfire season. Lastly I do you want to say to Mr Abrams, I 00:43:15.740 --> 00:43:19.995 can only imagine the trauma that your family 00:43:20.007 --> 00:43:23.799 and others in your circumstances, first 00:43:23.811 --> 00:43:31.864 of all, having your house burn down last year, and then to have wildfires again, you 00:43:31.876 --> 00:43:39.562 know, threaten your family, and then, looking at where does safety reside. These 00:43:39.574 --> 00:43:47.530 things are matters that all of us, as human beings and the human condition, must be 00:43:47.542 --> 00:43:51.893 keenly aware of as well as we look at leaving 00:43:51.905 --> 00:43:55.699 no community left behind, disadvantaged 00:43:55.711 --> 00:44:00.059 communites, people with disabilities, seniors 00:44:00.071 --> 00:44:03.672 and businesses and so forth. So thank 00:44:03.684 --> 00:44:11.373 you. And I'm, you'll have my aye vote, President Batjer, on this OII. Thank you. 00:44:11.398 --> 00:44:17.768 Um, I will echo the comments of both President Bachir and 00:44:17.780 --> 00:44:23.932 commissioner She aroma to the extent that thes air really important interacting 00:44:23.944 --> 00:44:27.466 proceedings, the basic rulemaking on D energy 00:44:27.478 --> 00:44:30.474 ization will be taking a look at these 00:44:30.486 --> 00:44:33.937 issues. But it's important that rule makings 00:44:33.949 --> 00:44:37.028 are supported with proper investigation 00:44:37.040 --> 00:44:40.560 and enforcement to ensure that the rulemaking 00:44:40.572 --> 00:44:43.490 that the rules that were set forth in 00:44:43.502 --> 00:44:49.811 that room making or followed So this this step is is a critical step to make that 00:44:49.823 --> 00:44:56.048 rule making meaningful and then sort of the third leg of that three legged stool 00:44:56.060 --> 00:45:02.297 is looking forward, Um, understanding what steps the utilities need to be taking 00:45:02.309 --> 00:45:08.517 to deal with wildfire and, um, climate change in the future. And so part of that 00:45:08.529 --> 00:45:14.519 is the wildfire mitigation plans. Part of that is, um, the climate adaptation 00:45:14.531 --> 00:45:17.588 proceeding that looks at looking at how 00:45:17.600 --> 00:45:21.283 utilities can plan ahead to look, look at other 00:45:21.295 --> 00:45:27.522 climate change impacts. Um, and we have ah workshop on that later this week, Um, 00:45:27.534 --> 00:45:33.899 things like the micro grid proceeding and other proceedings at the commission that 00:45:33.911 --> 00:45:40.211 will really be looking at. How can we take steps moving forward to mitigate these 00:45:40.223 --> 00:45:46.363 impacts? So I thank you for, um you are a quick work on this order, instituting 00:45:46.375 --> 00:45:52.989 investigation. President Better and I will be supporting it. Any other commissioners? 00:45:58.189 --> 00:46:02.032 In addition to what my 00:46:02.044 --> 00:46:05.971 colleagues said, I want to reiterate that this is one 00:46:05.983 --> 00:46:09.977 part of a comprehensive set of actions that the PUC is 00:46:09.989 --> 00:46:13.777 taking both short term, medium term, and long term. 00:46:13.789 --> 00:46:17.926 And Miss Kaplan, I wantto underscore that we are looking 00:46:17.938 --> 00:46:21.577 at a broader range of solutions to try to provide 00:46:21.589 --> 00:46:25.441 more distributed generation. Resiliency solutions to 00:46:25.453 --> 00:46:29.170 help the most vulnerable residents and communities 00:46:29.182 --> 00:46:32.799 around the state. We started on that path, but we 00:46:32.811 --> 00:46:36.731 have a lot more to do. We're very open to suggestions 00:46:36.743 --> 00:46:40.729 and ideas. We're looking at other measures through our 00:46:40.741 --> 00:46:44.376 disaster emergency, our emergency disaster relief 00:46:44.388 --> 00:46:48.298 proceeding, and will continue to try to do everything 00:46:48.310 --> 00:46:52.160 we can to incorporate the lessons we've learned from 00:46:52.172 --> 00:46:55.871 this year's power shut offs. And to make sure that 00:46:55.883 --> 00:46:59.884 next year is very different than this year. Thank you. 00:46:59.909 --> 00:47:01.294 Thank you. 00:47:01.319 --> 00:47:05.813 All right. If there are no other comments for many 00:47:05.825 --> 00:47:10.154 other Commissioners, I will ask the agenda clerk to please call the roll. 00:47:10.179 --> 00:47:14.783 - For item 2. Commissioner Shiroma. - Aye. - Commissioner Guzman Aceves. 00:47:14.808 --> 00:47:18.805 - Aye. - Commissioner Randolph. - Aye. 00:47:18.830 --> 00:47:21.753 - Commissioner Rechtschaffen. - Yes. 00:47:21.778 --> 00:47:23.882 - President Bater - Aye. 00:47:23.907 --> 00:47:27.176 Can I mention 00:47:27.188 --> 00:47:30.543 one other thing? Just related to this. It is 00:47:30.555 --> 00:47:33.754 important to note that in addition to this 00:47:33.766 --> 00:47:37.128 proceeding, in the PSPS or the denergization 00:47:37.140 --> 00:47:40.934 rulemaking that President Batjer is leading, we've 00:47:40.946 --> 00:47:44.305 also issued an order to show cause, directed 00:47:44.317 --> 00:47:47.445 at PG&E in particular, dealing with their 00:47:47.457 --> 00:47:50.895 specific actions lack of compliance with PSPS 00:47:50.907 --> 00:47:54.540 protocols that will be just focused on examining 00:47:54.552 --> 00:47:57.751 whether penalties and in what amount would 00:47:57.763 --> 00:48:04.321 be appropriate given their conduct relating to the recent round of shut offs. So that's 00:48:04.333 --> 00:48:07.820 an additional action that's separate from this 00:48:07.832 --> 00:48:11.033 order instituting investigation that we've 00:48:11.045 --> 00:48:17.534 just opened directly related to adjust the PG&E's actions over the past several weeks. 00:48:17.559 --> 00:48:24.040 Okay, Thank you. And just to reiterate, Item 2, the 00:48:24.052 --> 00:48:30.377 order instituting investigation passed unanimously. There is no report for 00:48:30.389 --> 00:48:37.045 items three and four on a recent consumer protection and safety activities and 00:48:37.057 --> 00:48:43.387 management reports. Our next regular agenda item are Commissioner reports. 00:48:43.399 --> 00:48:49.777 Is there anyone who would like to make a report? Seeing none, that finishes 00:48:49.789 --> 00:48:56.095 out that item. And so that is our last public meeting agenda. So thank you 00:48:56.107 --> 00:49:02.576 everyone for coming. And the public portion of the meeting is now adjourned. 00:49:02.588 --> 00:49:08.479 Please clear the room for closed session on legal matters. Thank you.
